Petition for: Acceptance of passing scores on the Uniform
Certified Public Accountancy Examination.
Statement of
Problem: Mr. Bohan earned
a Bachelor of Business Administration degree from Siena College in 2001. His education fully satisfies the
educational requirements for CPA licensure in New York.
Commissioner's Regulations specify that an applicant who passed two
subtests of the Uniform Certified Public Accountancy Examination at one
examination administration before December 4, 2003 has a transitional retention
period to obtain a passing score on the remaining sections of the computer-based
format of the examination. The
transitional period consists of the three-year period in which the applicant was
required to pass all sections of the paper-and-pencil examinations, extended to
the last day of the month in which the three-year period ends. However, the transitional period ends
earlier if the applicant has exhausted six opportunities to pass the remaining
sections of the examination.
Mr. Bohan passed
the Accounting and Reporting and Law subtests in November 2001. In May 2003, he passed the Financial
Accounting and Reporting subtest.
Mr. Bohan did not sit for the Auditing subtest at two of the
paper-and-pencil examination opportunites.
He failed the Auditing subtest twice in the paper-and-pencil format and
twice in the computer-based format.
Mr. Bohan passed the Auditing subtest on
November 30, 2004, one examination administration after the six attempts
allowed in Commissioner Regulations.
Mr. Bohan wrote to both the Department and the American institute of
Certified Public Accountants shortly after his August 2004 test administration
about difficulties he encountered during the computer-based examination. The examination required the candidate
to cut and paste an auditor's report.
The instructions for this procedure were not available as part of the
examination or from administrators at the test site. Although instructions were available on
a tutorial on the National Association of State Boards of Accountancy (NASBA)
website, the tutorial required high-speed internet access that was unavailable
to Mr. Bohan. At the November
examination date, the cut and paste instructions were included in the
examination and he passed the subtest at that time.
Mr. Bohan
asks that his passing scores on the four subtests of the Uniform Certified
Public Accountancy Examination be accepted as the substantial equivalent of
passing scores obtained under Commissioner’s Regulations. Based on Mr. Bohan's individual
circumstances, the Executive Secretary of the State Board for Public Accountancy
supports his request.

THREE-YEAR LIMITED LICENSE IN
PHARMACY
Petition for: Three-year limited license to practice
pharmacy under Section 6805(6) of the Education Law.
Statement of Problem:
The applicants listed below have met the education, examination and
experience requirements for licensure as a pharmacist in New York State. The
only requirement for full licensure that cannot be satisfied at this time is
United States citizenship or immigration status as an alien lawfully admitted
for permanent residence in the United States.
Each applicant also has a pending application for full pharmacy
licensure, which cannot be granted until he/she satisfies the citizenship or
permanent residency requirement.
Applicable Guidelines:
Section 6805(6) of Education Law relates to
the requirement of United States citizenship or permanent resident status for
licensure as a pharmacist in New York State and allows the Board of Regents to
grant a one time, three-year waiver (plus an extension of not more than one
year) for an alien pharmacist to practice in New York State if all other

Program at Community General Hospital, Syracuse, New York. He is petitioning for nurse practitioner
certification in the additional specialty area of psychiatry under alternative
criteria.
For certification in an additional specialty area under alternative
criteria, Commissioner's Regulations require, in addition to appropriate
education, evidence of 1,000 hours of clinical practice in the specialty area in
which the additional certification is sought in a health care facility licensed
pursuant to Article 28 of the Public Health Law. Mr. Daugherty has presented
evidence of over 1,000 hours of experience as a nurse practitioner in psychiatry
at the Central New York Psychiatric Center at Midstate Correctional Facility,
Marcy, New York. He asks that his
experience be accepted as the substantial equivalent of experience in an Article
28 facility. The Executive
Secretary of the State Board for Nursing supports his request.

Problem: Dr.
Gajendra did not complete the two academic years of study required in an
accredited dental school program culminating in certification that the applicant
has achieved the level of knowledge and clinical proficiency expected of a
graduate of that school. Such study
is required for applicants completing a program of dental education in an
unregistered or unaccredited dental school.
Dr. Gajendra completed the two-year advanced program in general dentistry
at the Eastman Dental Center of the University of Rochester in December 2004.
This program is acknowledged by the State Board for Dentistry as the substantial
equivalent of the two-year program required in regulation. Dr. Gajendra asks
that her study at the Eastman Dental Center of the University of Rochester be
accepted to satisfy Commissioner's Regulations.

Statement of
Problem: Dr.
Radcliffe satisfies the educational requirements for licensure in dentistry
through his study at the University of Pennsylvania, Philadelphia, Pennsylvania,
culminating in the D.D.S. degree awarded in May 1962.
Dr. Radcliffe was licensed in April 1962 in New Jersey on the basis of
the two-day New Jersey written and practical examination. Commissioner's Regulations require that
an applicant for licensure in dentistry in New York State must successfully
complete a licensing examination consisting of Parts I and II, designed to
sample knowledge from all areas related to dentistry, and Part III, an
examination in clinical dentistry, the scope and content of which shall be
determined by the State Board for Dentistry. Currently, the Department accepts
the National Board Dental Examinations to satisfy Parts I and II and the
Northeast Regional Board of Dental Examiners clinical examination to satisfy
Part III of the licensing examination requirement. In 1962, the National Board
Dental Examination was not a requirement for licensure in either New York or New
Jersey. Both states administered
their own state licensing examinations at that time.
Dr. Radcliffe has documented over 40 years of successful dental practice
in New Jersey. In addition, he was
awarded a Certificate in Endodontics by Columbia University in 1971. Dr. Radcliffe asks that the 1962 New
Jersey State licensing examination be accepted to satisfy the requirements in
Commissioner's Regulations. Based
on Dr. Radcliffe's unique situation, the Executive Secretary of the State Board
for Dentistry supports his request.

the education and examination requirements for licensure as a dentist in New
York State. The only requirement for full licensure that cannot be satisfied at
this time is United States citizenship or immigration status as an alien
lawfully admitted for permanent residence in the United
States.
Each applicant has an opportunity to practice dentistry in an area which
has been designated a Federal Dental Health Professions Shortage Area and
requests a three-year waiver of the citizenship requirement under Section
6604(6) of the Education Law. Each applicant must sign an affidavit stating the
exact location of the shortage area where he/she will practice before the
three-year limited license will be issued.
Applicable Guidelines: Section 6604(6) of Education Law relates
to the requirement of United States citizenship or permanent resident status for
licensure as a dentist in New York State and allows the Board of Regents to
grant a one time, three-year waiver of this requirement for an alien dentist to
practice in New York State if all other licensure requirements are satisfied and
to grant an additional extension not to exceed six years to enable the alien to
secure citizenship or permanent resident status, provided such status is being
actively pursued.

Statement of Problem: Dr. Hecht took and passed the National Board
of Chiropractic Examiners (NBCE) Part I examination in April 1971 and the Part
II examination in April 1972. The applicant has documented more than 30 years of
professional practice.
Commissioner’s Regulations permit acceptance of passing grades on the
NBCE examinations administered subsequent to September 1, 1977. The State Board for Chiropractic has
recommended, since April 1992, that all NBCE Part I and Part II passing scores
be accepted regardless of the date of administration.
In addition, Dr. Hecht lacks college coursework in physics. Section
24.3(a) of the Commissioner's Regulations allows the Committee on the
Professions (COP) to waive up to six semester hours of preprofessional
education. Department staff support
such action by the COP.

Satisfaction of proficiency examination and postgraduate hospital
training requirements and endorsement of her Norwegian medical
license.
Statement of Problem: Commissioner’s Regulations allow
endorsement of an applicant’s license from another jurisdiction if appropriate
requirements are met and the applicant has not failed any part of New York
State’s licensing examination. Dr. Birketvedt has never attempted this State’s
licensing examination. Commissioner’s Regulations allow endorsement of a license
granted in a foreign country if licensure in that country is regulated by an
acceptable organization with responsibility for quality assurance and provided
that the applicant meets the requirements of Sections 60.1 and 60.5. The
Executive Secretary of the State Board for Medicine has determined that medical
licenses granted in Norway satisfy such criteria.
The Executive Secretary of the State Board for Medicine has reviewed the
documentation submitted in support of Dr. Birketvedt’s application and
recommends that the proficiency examination, clinical competency examination,
and postgraduate hospital training requirements be considered satisfied.
Commissioner’s Regulations allow an acceptable diplomate certificate earned
through experience and examination to satisfy the clinical competency
examination. A review of the requirements for Dr. Birketvedt’s Specialty
Certificate in General Practice from the Norwegian Medical Association indicates
that it meets the criteria for satisfying the clinical competency examination
requirement. The Executive Secretary recommends that the applicant’s advanced
M.D./Ph.D. program in Gastroenterology and Neuroendocrinology satisfy the
proficiency examination requirement. Lastly, the Executive Secretary recommends
that her three-year residency at the University Hospital of Northern Norway and
her five-year fellowship at the University of Pennsylvania satisfy the required
three years of postgraduate hospital training.

completed an acceptable medical education program and received a medical degree.
Dr. Emamian completed the full medical curriculum and examinations required for
conferral of the medical degree by Tehran University of Medical Sciences.
However, the University requires that students complete a social service

Statement of
Problem: Applicants may be considered for
endorsement of an out-of-state medical license based on a state-constructed
examination taken prior to January 1, 1972, provided that this examination and
the required passing score were substantially equivalent to the New York State
examination administered during the same time period. By January 1, 1972, the majority of
states had adopted the Federation Licensing Examination (FLEX) as their medical
licensing examination.
Dr. Wood was licensed by the Georgia State Board of Medical Examiners
after passing its August 1973 state-constructed medical licensing
examination. The Department had
determined that the Georgia state-constructed medical examinations administered
through January 1, 1972 were substantially equivalent to the New York State
medical licensing examinations. The
Executive Director of the Georgia State Board of Medical Examiners previously
notified the Department that the examination taken by the applicant was equal to
any Georgia State Board examination offered prior to January 1972. The applicant achieved scores on this
examination that exceeded New York State requirements. Department staff support Dr. Wood’s
petition to accept the Georgia state-constructed medical licensing examination
as satisfying New York State’s licensing examination
requirement.

Summary Statement: The petitioners listed below are all
graduates of foreign medical schools who have been licensed in New
York.
The applicable requirements of Section 3.57 of the Rules of the Board of Regents require completion of a medical education program in a foreign medical school satisfactory to the Department which does not grant the degree Doctor of Medicine (M.D.), and in which the philosophy and curriculum were equivalent, as determined by the Department in accordance with the policy of the Board of Regents, to those in programs leading to the degree Doctor of Medicine (M.D.) at medical schools in the United States satisfactory to, or registered by, the Board of Regents and the Department. Secondly, petitioners must have licensure to practice medicine in New York State in accordance with provisions of Section 6524 or 6528 of the Education Law or their equivalent as determined by the Board of Regents pursuant to their authority under Section 6506 of the Education Law.
