Attached are summary recommendations with respect to charter applications. A total of 15 charter actions are recommended involving 15 institutions, including 6 historical societies, 1 library, 5 nonpublic schools, 2 other educational corporations and 1 not-for-profit corporation.
I recommend that the Regents approve each application in accordance with the recommendations contained in the respective summaries.

This corporation was incorporated by Special Act of the New York State Legislature by Chapter 197 of the Laws of 1818 on April 20, 1818 under the corporate name “The Lyceum of Natural History in the City of New York” to foster continuing education in the field of the sciences. Such absolute charter was amended by Order of the Supreme Court of the State of New York on January 5, 1876 to change the corporate name to “The New York Academy of Sciences” and amended by Chapter 181 of the Laws of 1902 on March 19, 1902 and by action of the Board of Regents on December 15,1978. The board of trustees has applied for an amendment to the absolute charter to restate the corporate purposes and to change the corporate address. The Office of Cultural Education recommends that the absolute charter be amended accordingly.

A provisional charter was granted to this corporation by action of the Board of Regents on October 17, 1929 to operate a free association library. Such provisional charter was extended by Regents action on October 17, 1941 and December 20, 1946 and made absolute by Regents action on December 20, 1951. The board of trustees has applied for an amendment to the absolute charter to add the language necessary to maintain tax-exempt status under Internal Revenue Code §501(c)(3) and to designate the Commissioner of Education as the agent of the corporation for the purpose of service of process. The Office of Cultural Education recommends that the absolute charter be amended accordingly.

corporation additional time to achieve a fully accessioned collection, duplicate

disturbed, or mentally retarded. Such provisional charter was made absolute on
September 21, 1973. Such absolute charter was amended by Regents action on
February 20, 1975 to change the corporate name to “Little Village School,” to
delete reference to children of preschool age from its corporate purposes and to
provisionally authorize the school to accept children up to the age of 10 until June 30, 1978;
September 22, 1978 to make absolute the authority provisionally granted on
February 20, 1975 to accept children ages eight through ten; June 21, 1979 to
authorize the school to offer instruction in grades nursery through six, to
accept autistic and multiply handicapped children, and to establish a day
treatment center for developmentally disabled children; September 21, 1979 to
change the location of the corporation and that of its principal office and
February 11, 2003 to change the corporate name to “The Hagedorn and Little
Village School.” The board of trustees has applied for an amendment to
the absolute charter to change the

Nonpublic School Services recommends that the absolute charter be amended

The Office of Vocational and Educational Services for Individuals with Disabilities (VESID) has been provided with an opportunity to review this action, and the trustees have been advised that the granting of this provisional charter does not constitute approval for State funding for programs and services under the jurisdiction of VESID’s Office for Special Education Services (OSES). The Office of Children and Family Services (OCFS) has consented to this action pursuant to §460-a of the Social Services Law. The Office of Nonpublic School Services recommends that a provisional charter be granted for a period of three years.

Evelyn Douglin Center for Children’s Services has petitioned the Board of Regents for a provisional charter. Evelyn Douglin Center for Children’s Services, Inc. was incorporated under §402 of the Not-For-Profit Corporation Law (NPCL) on July 29, 1999 with the consent of the New York State Education Department. Upon the effective date of the consolidation of Evelyn Douglin Center for Children’s Services and Evelyn Douglin Center for Children’s Services, Inc., Evelyn Douglin Center for Children’s Services will assume all the assets, liabilities and responsibilities of both organizations. The consolidated corporation will operate under the provisional charter granted to Evelyn Douglin Center for Children’s Services. The Office of Vocational and Educational Services for Individuals with Disabilities (VESID) has been provided with an opportunity to review this action, and the trustees have been advised that the granting of a consolidation does not constitute approval for State funding for programs and services under the jurisdiction of VESID’s Office for Special Education Services (OSES).
