REGISTERED PROFESSIONAL NURSING

05-01-22

Anna Surowiec

Brooklyn, NY 11214-1717

(Medyczne Studium Zawodowe No. 2, Krakow, Poland, Pielegniarki Psychiatrycznej, 1985)

Petition for:  Acceptance of education.

Statement of Problem:  Ms. Surowiec completed a three-year professional nursing program leading to a diploma of Pielegniarki Psychiatrycznej (psychiatric nursing) at the Medyczne Studium Zawodowe No. 2 in Krakow, Poland in January 1985.  The diploma awarded to graduates of the general nursing program is Pielegniarki.  Ms. Surowiec asks that her education be accepted as satisfying the professional educational requirements for licensure as a registered professional nurse.

Section 6905 of New York State Education Law requires that applicants for licensure as registered professional nurses must have received a diploma or degree in general nursing.  The applicant’s school of nursing has sent the Department copies of its nursing curricula, listing courses and hours for both its general nursing program and its psychiatric nursing program.  Department staff have reviewed the specific courses for both programs and have determined that the general nursing study in both programs is substantially the same. The three-year psychiatric program requires more total hours than the basic two-year general program and includes additional hours in psychiatry and psychiatric nursing.  Staff recommend that her nursing education be considered equivalent to the general nursing education required in Commissioner's Regulations.

APPLICABLE REQUIREMENTS:

QUALIFICATIONS:

Section 6905 of New York State Education Law and Section 64.1 of the Regulations of the Commissioner of Education require:

(1)  Graduation from a general nursing program of at least two academic years in a country outside the United States that is satisfactory to the Department and recognized by the licensing authorities of that country as being preparation for practice as a registered professional nurse.

(1)  Completed a three-year nursing program leading to diploma of Pielegniarki Psychiartrycznej at Medyczne Studium Zawodowe No. 2, Krakow, Poland, January 1985.

  (2) Satisfactory scores on the National Council Licensure Examination.

(2)

(3) Evidence of the required course in identification and reporting of child abuse and maltreatment.

(3)

RECOMMENDATION:   The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Nursing, recommends that the applicant’s petition for acceptance of her nursing education be approved.

RESPIRATORY THERAPY TECHNICIAN

05-01-53

Kenneth A. Wyka

Lake George, NY 12845-6410

Petition for:  Waiver of education requirements.

Statement of Problem:   Completion of at least a one-year satisfactory respiratory program is required to meet the education requirement for licensure as a respiratory therapy technologist. Mr. Wyka reports that from 1971 – 1972 he completed respiratory studies at Lenox Hill Hospital in New York City but is unable to document completion of the required year-long program.  The Hospital had a twelve-month certificate inhalation therapy program, which was professionally accredited from 1970 to 1974, but no longer has the old records available.  Mr. Wyka has submitted a certificate of recognition granted to him by the Hospital that he “successfully completed a ninety-six hour course of training in Inhalation Therapy on March 6, 1972.”  Although Mr. Wyka obtained B.S. and M.S. degrees in biology from Fairleigh Dickinson University, these documented studies are insufficient to satisfy New York State requirements for licensure.

Mr. Wyka passed the examinations of the National Board for Respiratory Care and became a Certified Respiratory Therapist and Registered Respiratory Therapist in 1973. He was licensed as a Respiratory Care Practitioner in New Jersey in 1992.  In addition, he has presented a record of achievement in the profession.  In the 1970’s, he was Director of the respiratory therapy educational program at Passaic County Community College in New Jersey; served from 1988 to 1996 on the faculty of the University of Medicine and Dentistry of New Jersey in Newark; taught at Montclair State College; and has authored textbooks in respiratory therapy.  Mr. Wyka has also extensively served the New Jersey Society for Respiratory Care.  This service included many years as delegate to the American Association for Respiratory Care, of which he was elected a Fellow in 2003.

APPLICABLE REQUIREMENTS:

QUALIFICATIONS:

Section 8510 of Education Law and Subpart 79-4 of the Regulations of the Commissioner of Education require:

(1)  Completion of an acceptable one-year program in respiratory therapy technician or a program deemed equivalent.

(1)  See Statement of Problem.

(2)  Satisfactory score/s on the National Board for Respiratory Care (NCRC) certification examination.

(2)(a)  Certified Respiratory Therapist (CRT), May 19, 1973

(2)(b)  Registered Respiratory Therapist (RRT), June 11, 1973.

RECOMMENDATION:   The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Respiratory Therapy, recommends that the applicant's petition for waiver of the education and examination requirements be accepted.

THREE-YEAR LIMITED LICENSE IN DENTISTRY

Petition for: Three-year limited license to practice Dentistry under Section 6604(6) of the Education Law.

Statement of Problem: The applicant listed below has satisfied the education and examination requirements for licensure as a dentist in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.

The applicant has an opportunity to practice dentistry in an area which has been designated a Federal Dental Health Professions Shortage Area and requests a three-year waiver of the citizenship requirement under Section 6604(6) of the Education Law. The applicant must sign an affidavit stating the exact location of the shortage area where she will practice before the three-year limited license will be issued.

Applicable Guidelines: Section 6604(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a dentist in New York State and allows the Board of Regents to grant a one-time, three-year waiver of this requirement for an alien dentist to practice in New York State if all other licensure requirements are satisfied and to grant an additional extension not to exceed six years to enable the alien to secure citizenship or permanent resident status, provided such status is being actively pursued.

ACTION: The Department shall issue a three-year limited license to the applicant to practice dentistry in New York State in a Federal Dental Health Professions Shortage Area upon approval by the Department of all documentation needed to verify satisfaction of all dentistry licensure requirements other than citizenship and an acceptable Affidavit of Agreement on the applicant’s location of employment.  The limited license may be renewed upon the lawful submission of an application for an extension of not more than six years, at the discretion of the Department.

The applicant has documented more than 23 years of  professional practice.  Commissioner’s Regulations permit acceptance of passing grades on the NBCE examinations administered subsequent to September 1, 1977.  The State Board for Chiropractic has recommended, since April 1992, that all NBCE Part I and Part II passing scores be accepted regardless of the date of administration.

In addition, Dr. DeLisi completed organic chemistry, a required preprofessional course in the basic sciences, during his professional studies and lacks college coursework in physics. 05-12-75

Walter Ruel Cowles

Lextington, KY 40511

(Auburn University School of Veterinary Medicine, Auburn, Alabama, D.V.M., 1979)

Petition for:  Waiver of New York State requirements pertaining to acceptability of licensing examinations for licensure by endorsement.

Statement of Problem:   Dr. Cowles graduated from an accredited college of veterinary medicine in the United States in 1979 and was licensed in Kentucky based on National Board Examination (NBE) scores in Georgia.  While Dr. Cowles passed the NBE in 1979, he has not taken the Clinical Competency Test (CCT).  For New York State licensure, applicants who passed the NBE must also pass the CCT, which was offered from 1984 until 2000.  When Dr. Cowles was licensed in 1980, the CCT was not offered.  The CCT and the NBE have been replaced by the North American Veterinary Licensing Examination (NAVLE).  Dr. Cowles has documented over 7 years of professional practice in Kentucky following licensure.

In view of Dr. Cowles’ years of licensed practice as evidence of clinical competence, staff of the New York State Board for Veterinary Medicine recommends that the CCT examination requirement be waived and the applicant’s Kentucky license be accepted for endorsement in New York State.

QUALIFICATIONS:

Section 6704 of the Education Law and Section 59.6 and Part 62 of the Regulations of the Commissioner of Education require:
