Should the Regents approve the recommendations of the Committee on the
Professions pertaining to licensing petitions as listed on the
attachment?
The question will come before the Higher Education & Professional
Practice Committee on June 21, 2005, on its consent agenda. It will then come before the Full Board
for final action on June 22, 2005.
Section 6506(5) of the Education Law and Part 24.7 of the Rules of the
Board of Regents authorizes the Regents to waive education, experience and
examination requirements for a professional license as well as confer the degree
Doctor of Medicine.
There are 9 licensing petitions and 10 requests for conferral of the
degree Doctor of Medicine for review and approval.
It is recommended that the Regents approve the
recommendations of the Committee on the Professions regarding licensing
petitions.
Approval of the Committee on the Professions’ recommendations will be
effective June 22, 2005.

Statement of
Problem: Ms. Surowiec
completed a three-year professional nursing program leading to a diploma of
Pielegniarki Psychiatrycznej (psychiatric nursing) at the Medyczne Studium
Zawodowe No. 2 in Krakow, Poland in January 1985. The diploma awarded to graduates of the
general nursing program is Pielegniarki.
Ms. Surowiec asks that her education be accepted as satisfying the
professional educational requirements for licensure as a registered professional
nurse.
Section 6905 of New York State Education Law requires that applicants for
licensure as registered professional nurses must have received a diploma or
degree in general nursing. The
applicant’s school of nursing has sent the Department copies of its nursing
curricula, listing courses and hours for both its general nursing program and
its psychiatric nursing program.
Department staff have reviewed the specific courses for both programs and
have determined that the general nursing study in both programs is substantially
the same. The three-year psychiatric program requires more total hours than the
basic two-year general program and includes additional hours in psychiatry and
psychiatric nursing. Staff
recommend that her nursing education be considered equivalent to the general
nursing education required in Commissioner's Regulations.

pursuant to Article 28 of the Public Health Law. Ms. Montgomery is presenting
evidence of 1,000 hours of experience as a nurse practitioner in geriatrics
under the direct supervision of Teresa P. Chan, M.D., at Weinberg Campus. Ms. Montgomery asks that her experience
be accepted as the substantial equivalent of experience in an Article 28
facility. Based on the nature and
degree of documented supervision, the Executive Secretary of the State Board for

Statement of
Problem: Completion of
at least a one-year satisfactory respiratory program is required to meet the
education requirement for licensure as a respiratory therapy technologist. Mr.
Wyka reports that from 1971 – 1972 he completed respiratory studies at Lenox
Hill Hospital in New York City but is unable to document completion of the
required year-long program. The
Hospital had a twelve-month certificate inhalation therapy program, which was
professionally accredited from 1970 to 1974, but no longer has the old records
available. Mr. Wyka has submitted a
certificate of recognition granted to him by the Hospital that he “successfully
completed a ninety-six hour course of training in Inhalation Therapy on March 6,
1972.” Although Mr. Wyka obtained
B.S. and M.S. degrees in biology from Fairleigh Dickinson University, these
documented studies are insufficient to satisfy New York State requirements for
licensure.
Mr. Wyka passed the examinations of the National Board for Respiratory
Care and became a Certified Respiratory Therapist and Registered Respiratory
Therapist in 1973. He was licensed as a Respiratory Care Practitioner in New
Jersey in 1992. In addition, he has
presented a record of achievement in the profession. In the 1970’s, he was Director of the
respiratory therapy educational program at Passaic County Community College in
New Jersey; served from 1988 to 1996 on the faculty of the University of
Medicine and Dentistry of New Jersey in Newark; taught at Montclair State
College; and has authored textbooks in respiratory therapy. Mr. Wyka has also extensively served the
New Jersey Society for Respiratory Care.
This service included many years as delegate to the American Association
for Respiratory Care, of which he was elected a Fellow in 2003.

THREE-YEAR LIMITED LICENSE IN
DENTISTRY
Petition for: Three-year limited license to practice Dentistry
under Section 6604(6) of the Education Law.
Statement of Problem: The applicant listed below has satisfied the
education and examination requirements for licensure as a dentist in New York
State. The only requirement for full licensure that cannot be satisfied at this
time is United States citizenship or immigration status as an alien lawfully
admitted for permanent residence in the United States.
The applicant has an opportunity to practice dentistry in an area which
has been designated a Federal Dental Health Professions Shortage Area and
requests a three-year waiver of the citizenship requirement under Section
6604(6) of the Education Law. The applicant must sign an affidavit stating the
exact location of the shortage area where she will practice before the
three-year limited license will be issued.
Applicable Guidelines: Section 6604(6) of Education Law relates to the
requirement of United States citizenship or permanent resident status for
licensure as a dentist in New York State and allows the Board of Regents to
grant a one-time, three-year waiver of this requirement for an alien dentist to
practice in New York State if all other licensure requirements are satisfied and
to grant an additional extension not to exceed six years to enable the alien to
secure citizenship or permanent resident status, provided such status is being
actively pursued.

Statement of
Problem:
Dr. DeLisi took and passed the National Board of Chiropractic Examiners (NBCE)
Part I examination in April 1976 and the Part II examination in April 1977. The
applicant has documented more than 23 years of professional practice. Commissioner’s Regulations permit
acceptance of passing grades on the NBCE examinations administered subsequent to
September 1, 1977. The State Board
for Chiropractic has recommended, since April 1992, that all NBCE Part I and
Part II passing scores be accepted regardless of the date of administration.
In addition, Dr. DeLisi completed organic chemistry, a required
preprofessional course in the basic sciences, during his professional studies
and lacks college coursework in physics. Section 24.3(a) of the Commissioner's
Regulations allows the Committee on the Professions (COP) to accept
preprofessional study taken after entry into the professional program and to
waive up to six semester hours of preprofessional education. Department staff support such action by
the COP.

Petition for: Waiver of New
York State requirements pertaining to acceptability of licensing examinations
for licensure by endorsement.
Statement
of Problem: Dr. Cowles graduated from an accredited college of
veterinary medicine in the United States in 1979 and was licensed in Kentucky
based on National Board Examination (NBE) scores in Georgia. While Dr. Cowles passed the NBE in 1979,
he has not taken the Clinical Competency Test (CCT). For New York State licensure, applicants
who passed the NBE must also pass the CCT, which was offered from 1984 until
2000. When Dr. Cowles was licensed
in 1980, the CCT was not offered.
The CCT and the NBE have been replaced by the North American Veterinary
Licensing Examination (NAVLE). Dr.
Cowles has documented over 7 years of professional practice in Kentucky
following licensure.
In view of Dr. Cowles’ years of licensed practice as evidence of clinical
competence, staff of the New York State Board for Veterinary Medicine recommends
that the CCT examination requirement be waived and the applicant’s Kentucky
license be accepted for endorsement in New York State.

applicant also has a pending application for full veterinary medical licensure,
which cannot be granted until he satisfies the citizenship or permanent
residency requirement.

Dr. Liu earned a diploma in 1983 from Beijing College of Traditional Chinese
Medicine following five years of study in a program that combined Traditional
Chinese Medicine and allopathic (Western) medicine. The program was 50%
allopathic medicine for the first two years and 60% allopathic medicine in the
last three years. In 1984, Dr. Liu
enrolled in Peking Union Medical College and earned a Master of Medicine degree
with a specialty in pathophysiology in May 1987.
Dr. Liu completed a four-year residency in anatomic and clinical
pathology at Hahnemann University, Philadelphia, Pennsylvania from June 2000
through June 2004. She is board
certified in anatomic and clinical pathology by the American Board of
Pathology. Currently, Dr. Liu is
completing a year of residency in hematopathology at Hahnemann University
Hospital, Philadelphia, Pennsylvania.
Dr. Liu asks that her
combined studies in Chinese and western medicine in the People’s Republic
of China and her advanced training in pathology and hematopathology in the
United States be accepted as the equivalent of the regulatory requirement of six
years of postsecondary education including a medical education of at least 32
months. Based on the unique
educational background of this applicant, the Executive Secretary of the State
Board for Medicine supports the applicant’s petition.

MEDICINE
Petition for: Conferral of the degree Doctor of Medicine (M.D.)
pursuant to Section 6529 of the Education Law.
Summary Statement: The petitioners listed below are all graduates of
foreign medical schools who have been licensed in New
York.
The applicable requirements of Section 3.57 of the Rules of the Board of
Regents require completion of a medical education program in a foreign medical
school satisfactory to the Department which does not grant the degree Doctor of
Medicine (M.D.), and in which the philosophy and curriculum were equivalent, as
determined by the Department in accordance with the policy of the Board of
Regents, to those in programs leading to the degree Doctor of Medicine (M.D.) at
medical schools in the United States satisfactory to, or registered by, the
Board of Regents and the Department.
Secondly, petitioners must have licensure to practice medicine in New
York State in accordance with provisions of Section 6524 or 6528 of the
