SUMMARY:
Manhattan Institute of Management, Inc. (MIM), 99 Hudson Street, Manhattan, is a Delaware not-for-profit corporation that offers noncredit curricula in business administration. Its student body is comprised of undergraduate and graduate students enrolled in foreign universities. These students will receive college credit from those universities for the courses taken at MIM. The Board of Regents first authorized MIM to operate in New York State on July 22, 1986. That permission has been renewed and amended over time, most recently on April 4, 2000. Permission expired on July 31, 2004. MIM has applied for renewal of its permission to operate. It seeks no change to the terms set by the Board of Regents. However, the Department has determined that the terms need to be modified to make it clear that MIM needs to receive a license from the Department’s Bureau of Proprietary School Supervision in order to offer noncredit courses in business administration to residents of New York State and to advertise in New York State. To date, MIM has not offered these courses to New York State residents.
Recommendation: I recommend that the Regents take the following action:
VOTED, that the permission granted to the Manhattan Institute of Management, Inc., Manhattan, to operate in New York State be extended for a period beginning August 1, 2004, authorizing the Institute:
1. until December 31, 2009, to offer in Manhattan undergraduate and graduate noncredit courses in business administration to students matriculated in foreign universities who will have previously attended an institution of higher education located outside the United States and who will be awarded credit for their course work by their home institution.
2. to offer noncredit courses in business administration to residents of New York State and to advertise in New York State after receiving a valid business school registration by the Department’s Bureau of Proprietary School Supervision for so long as such registration is maintained.

Renewal of Permission to Operate in New York
State
A. Institutional Information. Manhattan Institute of Management, Inc. (MIM), 99 Hudson Street, Manhattan, was incorporated in the state of Delaware on July 30, 1984. In August 1984, MIM applied for consent to filing with the Department of State an Application for Authority to Do Business in New York State. In September 1984, the Commissioner granted consent to filing the application.
MIM was established by the corporate officers of a French technical institute, the Institut Superiéur de Gestion, which was recognized by the rector of the Academy of Paris as a private technical establishment of higher education. The Institut was closed in 1997. At this time, MIM works with the European School of Economics, which has campuses in Italy and Great Britain, and Études Superiéures Appliquées aux Affairs, a private French higher education institution located in Paris. It has no operation in Delaware or any location other than Manhattan.
On July 22, 1986, the Board of Regents granted permission to MIM to offer courses in New York State for a period of five years. The Regents have periodically renewed this authorization through July 31, 2004. On April 4, 2000, the Regents amended the terms of MIM’s permission to operate, to read as follows:
(1) to offer in Manhattan undergraduate and graduate courses in business administration to students matriculated in foreign universities. These students will have previously attended an institution of higher education located outside the United States and will receive credit for their coursework from their home institutions;
(2) to offer noncredit courses in business administration to residents of New York State and to advertise in New York State.
MIM has applied for renewal of its permission to operate. It seeks no change to the terms set by the Board of Regents in 2000. However, the Department has determined that the terms need to be modified to make it clear that MIM needs to receive a license from the Department’s Bureau of Proprietary School Supervision in order to offer noncredit courses in business administration to residents of New York State and to advertise in New York State.
B. Courses and Curricula. MIM’s initial Application for Authority to do Business in New York State said that the purposes of the corporation to be pursued in New York State was:
To function as an
educational organization maintaining a regular faculty and curriculum and which
normally has a regularly enrolled body of students at its premises where its
educational activities are carried on; To teach and promote multinational
management techniques and to offer to the students of the institution formal
courses of instruction in such subjects as the Board of Trustees shall decide
are useful or necessary for the attainment of a high degree of individual
proficiency in business and management acumen, but not to operate or maintain an
institution of higher learning or to grant degrees in New York State.
MIM offers six noncredit curricula: Six-month International Business Studies; Six-month Intensive Business English; One-year Global Management (undergraduate); One-year International Business Management (graduate); New York International MBA; and Pre-MBA in New York. The New York International MBA curriculum is one semester in New York and one in Europe for students enrolled in programs offered by European universities. Students receive degrees from their universities upon completion of their entire program.
Across the six curricula MIM offers 29 subjects. The number ranges from four subjects in the Six-month Intensive Business English curriculum to 11 in the One-year International Business Management curriculum. A key element of each curriculum is one or more internships with firms in New York City. MIM states that internship partners include ABC News, Bank of New York, Citigroup, DKNY International, Prada, and Solomon Smith Barney.
C. Students. MIM is authorized to enroll (1) students matriculated in foreign universities who have previously attended an institution of higher education located outside the United States and (2) residents of New York State.
D. Faculty and Administration. MIM has a faculty of ten members, in the following disciplines: Accounting (2); American Business Law (2); Financial Management (1); Information Technology (1); Intensive English (2); International Marketing (3); Project Management (1). They are supported by an administration of five members.
E. Resources. MIM’s facilities are on the third and seventh floors of 99 Hudson Street (at Leonard Street). All courses are offered at that location, which provides classrooms and a computer lab.
