SUMMARY:
Attached are summary recommendations with respect to charter applications. A total of 19 charter actions are recommended involving 19 institutions, including 3 libraries, 5 museums, 2 historical societies, 8 nonpublic schools and 1 chartered postsecondary institution.
I recommend that the Regents approve each application in accordance with the recommendations contained in the respective summaries.

AMERICAN FOLK ART MUSEUM
New York City, New York County
A provisional charter was granted to this corporation under the corporate name “Museum of Early American Folk Arts” by action of the Board of Regents on June 23, 1961 to establish a museum of early American folk arts and their development. Such provisional charter was amended to change the corporate name to “Museum of American Folk Art” and, as amended, made absolute by Regents action on October 28, 1966; such absolute charter was amended by Regents action on July 27, 1979, January 18, 1989 and June 12, 2001 to change the corporate name to “American Folk Art Museum.” The board of trustees has applied for an amendment to the absolute charter to amend the purposes to include “related art expressions throughout the world, including but not limited to the work of contemporary self-taught artists.” The Office of Cultural Education recommends that the absolute charter be amended accordingly.

The board of trustees has petitioned the Board of Regents to form a corporation to rebuild and maintain a historically correct lighthouse and to operate a museum. The Office of Cultural Education recommends that a provisional charter be granted for a period of five years.

PLATTEKILL LIBRARY

A provisional charter was granted to this corporation by action of the Board of Regents on March 23, 1984 to operate an association library. Such provisional charter was made absolute by Regents action on April 14, 1989. Such absolute charter was amended by Regents action on July 28, 1989. The board of trustees has petitioned the Board of Regents for the dissolution of the charter as the corporation is no longer in operation and all taxes payable by the corporation have been paid. The trustees request Regents approval of the transfer of the library property to Plattekill Public Library, which was incorporated by action of the Board of Regents under a provisional charter on February 11, 2003. The Office of Cultural Education recommends that the absolute charter of the Plattekill Library be dissolved and that its library property be transferred to the Plattekill Public Library.

This corporation was incorporated by a
special act of the New York State Legislature, under Chapter 457 of the Laws of
2001, on November 13, 2001 to establish a public library funding district. Such
certificate was amended by Chapter 80 of the Laws of 2003 on June 18, 2003 and
Chapter 620 of the Laws of 2003 on September 30, 2003. The board of directors
has applied to restate the certificate of incorporation in its entirety which
will specify that the corporation is authorized to provide library services to
the residents of the district by contracting for same with the trustees of any
public or free association library registered with the Board of Regents or with
the trustees of a cooperative library system approved by the Commissioner of
Education to furnish library services to the people of the district; to add
language necessary to maintain tax-exempt status under Internal Revenue code
§501(c)(3); and to designate the Commissioner of Education as the agent for the
purpose of service of process. The Office of Cultural Education
recommends that the certificate of
incorporation be restated accordingly.

meet the requirements for an absolute charter.

The school is no longer in operation with the dissolution of the corporation having been approved by the State Supreme Court and all taxes payable by the corporation have been paid.
