Attached are summary recommendations with respect to charter applications. A total of 22 charter actions are recommended involving 23 institutions, including 1 library, 5 museums, 2 historical societies, 12 nonpublic schools, 2 chartered postsecondary institutions and 1 other education corporation.
I recommend that the Regents approve each application in accordance with the recommendations contained in the respective summaries.

A absolute charter in the first instance was granted to this corporation by action of the Board of Regents on March 1, 1963 to preserve and work for the preservation of historical buildings and landmarks in Suffolk County, New York, and to acquire, own and maintain one or more such landmarks and historical buildings, to maintain a museum and exhibit therein letters and other written material and artifacts of historical interest; and to promote and encourage historical research, to foster and promote public knowledge of and interest in local and national history. The board of trustees has applied for an amendment to the absolute charter to add the language necessary to maintain tax-exempt status under Internal Revenue Code §501(c)(3). Clifford A. Siegfried, David W. Palmquist and the Office of Cultural Education recommend that the absolute charter be amended accordingly.

The board of trustees has petitioned the Board of Regents to form a corporation to discover, procure, and preserve whatever shall relate to the natural, civil, literary and ecclesiastical history of the town of Marathon and the surrounding area, and to establish and maintain collections of art and archeology. A provisional charter was granted to this corporation by action of the Board of Regents on June 9, 1998 to perpetuate the memory and the spirit of the men and women of the Southern Tier of New York who supported the Underground Railroad and worked to protect the freedom of those who escaped slavery in the period surrounding the Civil War; to encourage historical research into the relationship among the Underground Railroad, the Civil War and the Southern Tier of New York; to locate, study, preserve and make available for public study and examination the documents, records and artifacts of the people and institutions of the Southern Tier of New York involved in the Underground Railroad and the Civil War; and to specifically purchase, restore and maintain the home of John W. Jones and related artifacts as a museum in memory of his role in the Underground Railroad in the Southern Tier. The board of trustees has applied for an extension of the provisional charter. Clifford A. Siegfried, David W. Palmquist, Christine Kleinegger and the Office of Cultural Education recommend that the provisional charter be extended for a period of five years to allow the corporation additional time to, among other things, focus on opening the John W. Jones house as a historic house and museum; to arrange to store the collections in the museum; to develop an exhibit program that will utilize the collections and research being generated; to develop a curriculum for school groups and otherwise demonstrate that it can meet the requirements for an absolute charter.

The boards of trustees of Shaker Museum and
Library and Mount Lebanon Shaker Village have petitioned the Board of Regents,
pursuant to Education Law §223, for an order of consolidation of Shaker Museum
and Library and Mount Lebanon Shaker Village. Shaker Museum and Library was
incorporated by action of the Board of Regents under the corporate name “Shaker
Museum Foundation” on July 21, 1950; such provisional charter was made absolute
by action of the Board of Regents on July 29, 1955. Such absolute charter was
amended by Regents action on July 27, 1990 to change the corporate name to
“Shaker Museum and Library.” Mount Lebanon Shaker Village was incorporated by
action of the Board of Regents under a provisional charter granted on October
23, 1984 and consolidated on that date with Mount Lebanon Shaker Village, Inc.,
a Delaware corporation. Such provisional charter was made absolute by action of
the Board of Regents on March 25, 1988. Such absolute charter was consolidated
with Mount Lebanon Heritage Foundation, an education corporation incorporated by
the Board of Regents on July 28, 1989, on May 21, 1993 with the surviving
corporation being “Mount Lebanon Shaker Village.” Upon the effective date of the
consolidation of Shaker Museum and Library and Mount Lebanon Shaker Village,
Shaker Museum and Library will
assume all the assets, liabilities and responsibilities of both organizations.
The consolidated corporation will operate under the absolute charter granted to
Shaker Museum and Library. Clifford A. Siegfried, David W. Palmquist
and the Office of Cultural Education recommend that an order of consolidation of the Shaker Museum and

Such provisional charter was extended by Regents action on May 24, 1974 and was amended by Regents action on January 25, 1978 to delete authority for the school to operate a secondary program and, as so amended, made absolute. Such absolute charter was amended by Regents action on July 17, 1998 to add authority for the school to also operate a grade nine program and September 17, 1999 to add authority for the school to also operate a grades ten through twelve program and on September 12, 2003 to change the corporate name to “Morriss Center School.” The board of trustees has applied for an amendment to the absolute charter to expand the authority of the corporation to include such educational, cultural, artistic and scientific activities in support of, and/or in conjunction with, the School and its surrounding community. This corporation was formed by an order of consolidation of the Board of Regents on September 20, 1946 consolidating the New York Protestant Episcopal Public School and the Pawling School. The New York Protestant Episcopal Public School was incorporated by Chapter 52 of the Laws of 1806, under the corporate name “Trustees of the First Protestant Episcopal Public School in the City of New York,” which name was subsequently changed to New York Protestant Episcopal Public School by Chapter 289 of the Laws of 1827. The Pawling School was incorporated by the Board of Regents by the issuance of a provisional charter on June 19, 1930; which provisional charter was made absolute by action of the Board of Regents on January 17, 1941. The charter was amended and restated in its entirety by Regents action on February 26, 1976. The board of trustees has applied for an amendment to increase the maximum number of trustees from 30 to 35. Thomas E. Hogan and the Office of Nonpublic School Services recommend that the absolute charter be amended accordingly.

27, 1975 and was consolidated by Regents action on June 21, 1979 with Jewish
Teachers Seminary and People’s University, a domestic corporation incorporated
pursuant to Chapter 593 of the Laws of 1935 and with Herzliah Hebrew Teachers
Institute, Inc., which was incorporated by action of the Board of Regents under
the corporate name “Herzliah Hebrew Academy, Inc.” on February 15, 1923 and
amended by Regents action on February 15, 1946 to change the corporate name to
“Herzliah Hebrew Teachers Institute, Inc.” Such provisional charter was amended
and extended numerous times, and was made absolute by Regents action on January
17, 1990. Such absolute charter was again amended by Regents action on September
19, 1997 and on April 29, 2003 to add authority for the University to confer the
degree of Doctor of Physical Therapy (D.P.T.) at the Main Campus in Manhattan
and at its Branch Campus in Huntington, New York. The board of trustees has
