Report of Regents P-12 Education Committee to The Board of Regents

The P-12 Education Committee held its scheduled meeting on October 3, 2022. All members were present except for Regent Tilles and Regent Tanikawa who were both excused. Chancellor Young, Regent Collins, Regent Reyes, and Regent Mittler also attended the meeting but did not vote on any action.  

ACTION ITEMS

Proposed Amendment of Section 100.5(d)(7) of the Regulations of the Commissioner of Education Relating to Requirements for Members of the Standing Committee for the Regents Examination Appeals Process [P-12 (A) 1] – Revised - Department staff presented, for emergency adoption, proposed amendments to the Commissioner’s regulations to address instances where schools do not have the requisite numbers of administrators to serve on the standing committee for Regents Examination appeals.

The Committee recommends that section 100.5(d)(7) of the Regulations of the Commissioner of Education be amended, as submitted, effective October 4, 2022, as an emergency action upon a finding of the Board of Regents that such action is necessary for the preservation of the general welfare to immediately provide regulatory flexibility so that all schools and districts can complete the special appeal process.

The motion passed unanimously.  Regent Norwood was absent for the vote.

Proposed Addition of Section 100.22 and Amendment of Section 200.6 of the Regulations of the Commissioner of Education Relating to Instruction Provided to Students in a Home, Hospital, or Institutional Setting Other Than a School (Homebound Instruction) [P-12 (A) 2] -  Department staff presented, for emergency adoption, revisions to the proposed addition of section 100.22 and amendment of section 200.6 of the Commissioner’s regulations relating to instruction provided to students in a home, hospital, or institutional setting other than a school.

The Committee recommends that section 200.6 of the Commissioner’s regulations be amended, and section 100.22 of the Regulations of the Commissioner of Education be added, as submitted, effective October 4, 2022, as an emergency action upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare to ensure that districts and parents or guardians receive clarity as to the circumstances under which “homebound” instruction may be requested and delivered for the upcoming school year and to ensure the emergency action taken at the September 2022 meeting, remains continuously in effect.

The motion passed. Regent Catania voted no.

Proposed Amendment of Sections 100.19 and 100.21 of the Regulations of the Commissioner of Education Related to Restarting the Accountability System using 2021-2022 School Year Results [P-12 (A) 3] - Department staff presented proposed amendments to the Commissioner’s regulations relating to the planned adjustments to the ESSA Accountability system that will be implemented in the 2022-2023 school year following two years of USDE provided waivers that allowed the Department to suspend accountability determinations due to COVID-19 disruptions. 

The Committee recommends that sections 100.19 and 100.21 of the Regulations of the Commissioner of Education be amended, as submitted, as an emergency measure, effective October 4, 2022, upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare in order to immediately align the Regulations of the Commissioner of Education with the Department’s ESSA Accountability State Plan Addendum.

The motion passed unanimously.

The P-12 Education Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations at its meeting on October 4, 2022, copies of which have been distributed to each Regent.
