The P-12 Education Committee held its scheduled meeting on March 10, 2025. All members were present. Chancellor Lester W. Young, Jr., Regent Susan W. Mittler, Regent Adrian I. Hale, Regent Hasoni L. Pratts, Regent Patrick A. Mannion, and Regent Brian Krist also attended the meeting.
ACTION ITEMS
Perkins V State Plan [P12 (A) 1] - Department staff updated the Board on public response to the proposed revisions to the Perkins V State Plan and requested approval for submission to USDE in May 2025.
The Committee recommends that the Board of Regents approve the revisions to New York’s Perkins V State Plan as attached and direct staff to submit the revised plan to the office of the Governor for review, and, subsequently to the U.S. Department of Education no later than May 1, 2025.
The motion passed unanimously.
Proposed Amendment of Sections 100.5(a) and (b) and 100.4(d) of the Regulations of the Commissioner of Education Relating to Exemptions from Diploma Assessment Requirements for Major Life Events [P12 (A) 2] - Department staff presented the proposed amendment to the Commissioner’s regulations to allow a superintendent (or the principal/head of school of a registered nonpublic school or charter school, as applicable) to make a local determination to provide exemptions from the diploma assessment requirements for students who experienced a major life event prior to the planned administration of a required diploma assessment (i.e., Regents Examination, NYSED-Approved Regents Examination Alternative, or a NYSED-Approved Pathway Assessment).
The Committee recommends that sections 100.5(a) and (b) and 100.4(d) of the Regulations of the Commissioner of Education be amended, as submitted, effective March 11, 2025, as an emergency action upon a finding of the Board of Regents that such action is necessary for the preservation of the general welfare to provide regulatory flexibility so that eligible students may be granted exemptions from diploma assessment requirements for major life events.
The motion passed unanimously.
MOTION FOR ACTION BY FULL BOARD
The P-12 Education Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee’s deliberations at its meeting on March 11, 2025, copies of which have been distributed to each Regent.
MATTERS NOT REQUIRING BOARD ACTION
Proposed Amendment of Section 19.5 of the Rules of the Board of Regents and Section 200.22 of the Regulations of the Commissioner of Education Relating to the Prohibition of Corporal Punishment, Aversive Interventions, Prone Restraint and Seclusion; and Standards for Behavioral Interventions [P12 (D) 1] - Department staff presented both a proposed amendment of Section 19.5 of the Rules of the Board of Regents to conform with the amended Section 305 of the Education Law (as added by Chapter 551 of the Laws of 2024) that prohibits corporal punishment in all schools public and private, and a proposed amendment to Section 200.22 of the Regulations of the Commissioner of Education indicating behavioral interventions for students with disabilities will be provided in accordance with Section 19.5 of the Rules of the Board of Regents.
