Report of Regents P-12 Education Committee to The Board of Regents

Regents Committee on P-12 Education Members

The P-12 Education Committee held its scheduled meeting on December 9, 2024. All members were present except for Regent James E. Cottrell who was excused. Chancellor Lester W. Young, Jr., Regent Luis O. Reyes, Regent Susan W. Mittler, Regent Adrian I. Hale, Regent Hasoni L. Pratts, and Regent Patrick A. Mannion also attended the meeting but did not vote on the action item.

ACTION ITEMS

Proposed Addition of Part 124 and Subpart 124-2 to Subchapter E of the Regulations of the Commissioner of Education Relating to Regionalization Plans  [P12 (A) 1] - Department staff presented a proposed regulatory amendment for final adoption for each component district in a supervisory district. The amendment includes non-substantive changes to allow them to engage in conversations with the aim of collaborating to create 37 district led regionalization plans across the state every ten years. The non-substantive changes include reiterating that participation in regionalization conversations is optional and creates a process by which districts can opt out of such conversations. The goal of these plans is to provide districts with a platform to formally contemplate ways they can improve student opportunities and operational efficiencies, to get the resources needed to achieve this, and to develop a mechanism by which participating districts can convey such needs to NYSED.

The Committee recommends that the Board of Regents finds that Part 124 and Subpart 124-2 of Subchapter E of the Regulations of the Commissioner of Education be added, as submitted, effective December 24, 2024.

The motion passed unanimously.

Proposed Amendment of Section 100.3 of the Regulations of the Commissioner of Education Relating to Evidence-based and Scientifically Based Reading Instruction [P12 (A) 2]  -  Department staff presented proposed amendments to section 100.3 of the Commissioner’s regulations relating to evidence-based and scientifically based reading instruction and literacy definitions to implement section 818 of the Education Law, as added by Part B of Chapter 56 of the Laws of 2024.

The Committee recommends that the Board of Regents finds that section 100.3 of the Regulations of the Commissioner of Education be amended, as submitted, effective December 10, 2024, as an emergency rule upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare to immediately implement and conform the Commissioner’s regulations to Education Law §818, which became effective April 1, 2024

The motion passed unanimously.

MOTION FOR ACTION BY FULL BOARD

The P-12 Education Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee’s deliberations at its meeting on December 10, 2024, copies of which have been distributed to each Regent.
