Report of Regents Higher Education Committee to The Board of Regents

Your Higher Education Committee held its scheduled meeting on November 14, 2017.  All members were present with the exception of Regent Cashin. Committee was chaired by Regent Collins.

MOTION FOR ACTION BY FULL BOARD

Madam Chancellor and Colleagues:  Your Higher Education Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee’s deliberations at its meeting on November 14, 2017, copies of which have been distributed to each member of the Board of Regents.

Matters Not Requiring Board Action:

Proposed Amendment to Sections 52.21 and 80-5.22 of the Regulations of the Commissioner of Education Relating to Preprofessional Certificates and Transitional Certificates - Your Committee discussed a proposed amendment to Subpart 52.21 of the Regulations of the Commissioner of Education relating to candidates who hold pre-professional teaching assistant certificates and who are enrolled in an educator preparation program. The amendment will allow these candidates employed under a pre-professional certificate to complete the student teaching program requirement in Section 52.21 of the Regulations while continuing to be employed by that district. Your Committee also discussed a proposed amendment to 80-5.22 relating to the Transitional G certificate. Currently, only individuals with a graduate degree and postsecondary teaching experience in a science, technology, engineering, or math (STEM) field are eligible to pursue a Transitional G certificate. The amendment will allow individuals with graduate degrees and postsecondary teaching experience in any certificate area to pursue a Transitional G certificate. Following the 45-day public comment period required under the State Administrative Procedure Act, it is anticipated that the proposed amendment will come back to the Board of Regents at its February 2018 meeting. If adopted at the February 2018 meeting, the proposed amendment will become effective on February 28, 2018.  HE (D) 1

Proposed Amendment to Regents Rules and Commissioner’s Regulations to Establish Fees and Procedures for the Consideration of Applications for New Degree-Authority - Your Committee discussed a proposed amendment that would establish procedures and a fee structure for all applications to establish new degree-granting institutions in New York State. Following the 45-day public comment period required under the State Administrative Procedure Act, it is anticipated that the proposed amendment will come back to the Board of Regents at its February 2018 meeting. If adopted at the February 2018 meeting, the proposed amendment will become effective on February 28, 2018.  HE (D) 1

Proposed Amendment to Regents Rules Subpart 27-1 and 27-2 Related to Higher Education Opportunity Programs - Your Committee discussed proposed amendments to Subparts 27-1 and 27-1 of the Regents Rules related to Higher Education Opportunity Programs (HEOP) to clarify the existing language related to eligibility requirements and to add a new Section 27-2 which standardizes the eligibility requirements for opportunity programs across all sectors. Following the 45-day public comment period required under the State Administrative Procedure Act, it is anticipated that the proposed amendment will come back to the Board of Regents at its February 2018 meeting. If adopted at the February 2018 meeting, the proposed amendment will become effective on February 28, 2018.  HE (D) 1

2018-2019 Legislative and Budget Priorities - You Committee was presented with the 2018-2019 Legislative and Budget Priorities.

Consent Agenda

The Board of Regents acted on the following consent agenda items at the November 2017 meeting.

Master Plan Amendment: The College of Westchester, Bachelor of Science (B.S.) Degree in Information Technology - Approved an amendment to the master plan of The College of Westchester to authorize the College to grant the Bachelor of Science degree in Information Technology.  The amendment will be effective until November 30, 2018, unless the Department registers the degree program prior to that date, in which case the master plan amendment shall be without term. Proposed Amendment to 80-1.5 Related to the edTPA Safety Net and the Multiple Measures Review Process - Approved an amendment of Section 80-1.5 of the Commissioner’s Regulations, effective December 11, 2017, as a second emergency action to preserve the general welfare by ensuring that teacher candidates who will be taking the edTPA from the time the new passing score is implemented until the implementation of the Multiple Measures Review Process are able to take advantage of the Safety Net and are not at a disadvantage. Following the 45-day public comment period required under the State Administrative Procedure Act, it is anticipated that the proposed amendment will be presented to the Board of Regents for adoption at its December 2017 meeting.  If adopted at the December Regents meeting, the proposed amendment would become effective as a permanent rule on December 27, 2017.
