Change in Scope of Institutional Accreditation: Utica School of Commerce

Your Committee discussed the change in scope of institutional accreditation of Utica School of Commerce and VOTED: That the Board of Regents approve a change in scope of the institutional accreditation of the Utica School of Commerce, in recognition of the institution’s ability to offer instruction via distance education. Transfer of Degree-Conferring Authority Based Upon a Change of Ownership or Control of the School of Visual Arts, LLC (School of Visual Arts)

Your Committee discussed the transfer of degree-conferring authority based upon a change of ownership or control of School of Visual Arts, LLC (School of Visual Arts) and VOTED: That contingent upon the transfer and sale of the membership interests of the School of Visual Arts, LLC from Chelgram Holding Corporation (formerly SVA, Inc.) to SVA Alumni Society, Inc., the Board of Regents consents to the transfer of degree conferring authority from the School of Visual Arts, LLC, with 100% membership interest owned by Chelgram Holding Corporation (formerly SVA, Inc.) to the School of Visual Arts, LLC, with 100% membership interest owned by SVA Alumni Society, Inc.  It is anticipated that the transfer and sale of the membership interests of the School of Visual Arts, LLC from Chelgram Holding Corporation (formerly SVA, Inc.) to SVA Alumni Society, Inc. will occur on or about September 1, 2016.  The transfer of degree conferring authority for the School for the Visual Arts, LLC will take effect immediately upon the transfer and sale of the membership interests in the School of Visual Arts, LLC, from Chelgram Holding Corporation to SVA Alumni Society, Inc.  HE (A) 2

Adoption of a New Subpart 80-6 of the Regulations of the Commissioner of Education to Implement Chapter 56 of the Laws of 2015 Relating to the Registration Process for any Holder of a Certificate that is Valid for Life (Permanent, Professional and Teaching Assistant Level III) and the Establishment of Continuing Teacher and Leader Education (CTLE) Requirements for Professional and Teaching Assistant Level III Certificate Holders 

Your Committee discussed regulations to implement Chapter 56 of the Laws of 2015 relating to the registration process for Permanent, Professional and Teaching Assistant Level III certificate holders and to establish continuing teacher and leader education requirements for Professional and Teaching Assistant Level III certificate holders and VOTED:  That a new Subpart 80-6 of the Regulations of the Commissioner of Education be added, as submitted, effective June 20, 2016, as an emergency action upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare in order to timely implement the provisions of Subpart C of Part EE of Chapter 56 of the Laws of 2015 to ensure that teachers and school leaders are provided with sufficient notice of the new registration requirements and to ensure that there are a sufficient number of approved sponsors by July 1, 2016 so that teachers and leaders can comply with the new continuing teacher and leader education requirements by the statute’s stated effective date and to ensure that the emergency adoption taken at the March 2016 meeting remains continuously in effect until it can be adopted as a permanent rule; and it was further VOTED:  That a new Subpart 80-6 of the Regulations of the Commissioner of Education be added, as submitted, effective, July 1, 2016.  This amendment will become effective as an emergency rule on June 20, 2016 and as a permanent rule on July 1, 2016.   HE (A) 3

Proposed Amendment to Section 80-3.5 of the Commissioner’s Regulations to Establish New Pathway Options for the Transitional A Certificate in a Career and Technical Education Subject for Candidates who do not Meet the Current Requirements but who Possess Industry Experience, Credentials, or are in the Process of Completing Certification 

Your Committee discussed amending Section 80-3.5 of the Commissioner’s Regulations to establish new pathway options for the Transitional A certificate in a career and technical education subject for candidates who do not meet the current requirements but who possess industry experience, credentials, or are in the process of completing certification and VOTED:  That new paragraphs (5), (6), and (7) are added to subdivision (b) of Section 80-3.5 of the Regulations of the Commissioner of Education, effective June 14, 2016, as an emergency action upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare in order to increase the supply of qualified, certified teachers in the career and technical education field to satisfy the increasing demand for those teachers in the 2016-2017 school year.  The proposed amendment will become effective as an emergency rule on June 14, 2016.  It is anticipated that the proposed amendment will then come before the Full Board for adoption as a permanent rule at the September 2016 Regents meeting.  If adopted at the September Regents meeting, the proposed amendment will become effective as a permanent rule on September 28, 2016.  HE (D) 1

Madam Chancellor and Colleagues:  Your Higher Education Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee’s deliberations at its meeting on June 14, 2016, copies of which have been distributed to each member of the Board of Regents.

Other Matters not requiring action:

Overview of Article 129-B “Enough is Enough” Combating Sexual Assault on College Campuses. Your Committee heard an overview of the new law relating to the establishment of policies and procedures regarding sexual assault, dating violence, domestic violence and stalking prevention on college and university campuses.

Update on edTPA Task Force Work.  Regent Cashin provided an update on her and Regent Collins work in relation to the certification exams and the edTPA Task Force.
