Action Items
Proposed Amendment of Section 30-1.3 of the Rules of the Board of Regents and Subpart 82-1 and Addition of a New Subpart 82-3 of the Regulations of the Commissioner of Education Relating to Probationary Appointments and Tenured Teacher Hearings To Implement Subparts D and G of Chapter 56 of the Laws of 2015. Your Committee reviewed the proposed amendments and recommends that subdivision (d) of Section 30-1.3, the title of Subpart 82-1, and Section 82-1.1 of the Regulations of the Commissioner of Education be amended, and that a new Subpart 82-3 of the Regulations of the Commissioner of Education be added, as submitted, effective September 21, 2015, as an emergency action upon a finding of the Board of Regents that such action is necessary for the preservation of the general welfare in order to revise the regulation to timely implement the provisions of Subparts D and G of Chapter 56 of the Laws of 2015 and to ensure that the rule remains continuously in effect until it can be adopted as a permanent rule. It is anticipated that the proposed amendment will be presented to the Board of Regents for permanent adoption at the November 2015 Regents meeting, after publication of the proposed amendment in the State Register for the 30-day public comment period required under the State Administrative Procedure Act for revised rulemakings. If the proposed amendment is adopted at the November meeting, the proposed amendment will become effective on December 2, 2015. HE (A) 2
Emergency Adoption of Proposed Amendments to Part 52 of the Regulations of the Commissioner of Education Relating to Minimum Admission Standards for Graduate-Level Teacher and Educational Leadership Programs and Requirements for the Suspension and/or Deregistration of Certain Programs with Completers Who Fail to Achieve a Minimum Pass Rate on Certification Examinations for Three Consecutive Years. Your Committee reviewed the proposed amendments and recommends that Section 52.21 of the Regulations of the Commissioner of Education be amended, as submitted, effective September 21, 2015, as an emergency action, upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare, in order to timely implement the provisions of sections 210-a and 210-b. It is anticipated that the proposed amendment will be adopted by the Board of Regents as a permanent rule at their December 2015 meeting. If adopted at the December 2015 meeting, the proposed amendment will become effective as a permanent rule on December 30, 2015. HE (A) 1
