Issue for Discussion

 

              With input from the field, a list of mandates that are most often questioned and/or cited by school districts has been developed (attached).   The list is by no means exhaustive and will be posted on the Department’s web site with a request to the field to notify us of any critical mandates that should be considered for addition. It should be noted that in order to develop a list of all mandates, a common definition would need to be developed and all statutes, regulations and policies would need to be vetted against that definition.  It is not our intent at this time to enter into such a project

              At the April Regents meeting, some of these mandates, and possible flexibility and/or relief for school districts, will be discussed during the Regents Committee meetings

Notes:

1. The list includes mandates most commonly cited by school officials, school board members and members of the public. The list does not include every possible mandate that schools are subject to, including mandates from other state agencies.

2. Districts may share a service and contract with BOCES to provide the service. Many shared services are eligible for BOCES aid.

3. Wellness Policy only required for school districts participating in the federal school breakfast and lunch programs.

4. "Aid Restricted" means that some parts of the BOCES service are not eligible for BOCES Aid; Restrictions vary by type of service.

5. District may use flexible aids such as, foundation to pay for mandates.

6. Funds follow the students. Some of the charter tuition comes from state aid the districts receives and some from the local share. Districts pay for charter student transportation but receive State Transportation Aid.
