Proposed Handling
This question will come before the full Board at its June 2009 meeting where it will be voted on and action taken.
Procedural History
Section 6506(5) of the Education Law and Section 24.7 of the Rules of the Board of Regents authorize the Regents to waive education, experience and examination requirements for a professional license as well as to confer the degree Doctor of Medicine.
Background Information
There are 4 licensing petitions and 10 requests for the conferral of the degree Doctor of Medicine for review and approval.
Recommendation
It is recommended that the Regents approve the recommendations of the Committee on the Professions regarding licensing petitions.
Timetable for Implementation
Approval of the Committee on the Professions’ recommendations will be effective June 23, 2009.

Petition for: Acceptance of passing grades on the Uniform Certified Public Accountancy (CPA) Examination.
Statement of Problem: Mr. Dietz is an applicant for licensure as a certified public accountant through endorsement of his license from Pennsylvania issued in July 1979. Pennsylvania experienced a fire in their archives in 1994 and lost some examination records, including Mr. Dietz’ records.
The Pennsylvania Bureau of Professional and Occupational Affairs has sent a letter explaining that they can confirm that Mr. Dietz successfully passed all sections of the Uniform CPA Examination with a score of 75 or higher; however, they cannot verify the date he passed the first section of the Examination or his individual scores for each section of the Examination. Pennsylvania regulations in effect in 1979 allowed candidates an unlimited amount of time to pass the final section of the Examination once a candidate passed the initial section. New York regulations in effect at the time required a candidate to pass all four sections of the Examination within a three-year period.
Given Pennsylvania’s assurance that Mr. Dietz passed all sections of the Examination, the Executive Secretary of the State Board for Public Accountancy supports his petition that he has passed all four parts of the Uniform CPA Examination.

Petition for: Acceptance of passing grades on the Uniform Certified Public Accountancy (CPA) Examination.
Statement of Problem: Mor Gil-Hafetz, an applicant for licensure as a certified public accountant, passed all four parts of the Uniform CPA Examination; however, she exceeded the 18-month conditioning requirement by 5 months.
Ms. Gil-Hafetz received conditional credit for passing the Auditing and Attestation (AUD) section in November 2006. She needed to pass the remaining three sections of the Examination by June 2008 to retain credit for AUD. She passed the Regulation (REG) section in January 2008 and the Business Environment and Concepts (BEC) section in April 2008, both within the conditioning period. She attempted the Financial Accounting and Reporting (FAR) section in May 2008 and August 2008, before passing in November 2008, five months after she lost credit for AUD.
Ms. Gil-Hafetz was diagnosed with an illness and underwent treatment six months after she passed her first section of the Examination. Based on medical documentation and her continued efforts to pass the FAR section, the Executive Secretary of the State Board for Public Accountancy supports Ms. Gil-Hafetz petition to waive the 18-month requirement to pass all four parts of the Uniform CPA Examination.

Petition for: Acceptance of education.
Statement of Problem: Commissioner’s Regulations require the completion of two years of pre-professional education with required subjects prior to matriculation into the professional dental program. Dr. Restrepo-Jaramillo completed one year of pre-professional education and covered all the required pre-professional subject areas except for general chemistry and organic chemistry. After graduating from dental school, Dr. Restrepo-Jaramillo completed the one-year Temporomandibular Joint Dysfunction Program at Eastman Dental Center. The Acting Executive Secretary of the State Board for Dentistry recommends that this program fulfill the pre-professional deficiencies. Commissioner’s Regulations allow the Committee on the Professions to accept up to 30 semester hours of study completed after the professional program toward the pre-profesional requirement.
Additionally, Dr. Restrepo-Jaramillo did not complete the two academic years of study required in an accredited dental school program culminating in certification that the applicant has achieved the level of knowledge and clinical proficiency expected of a graduate of that school. Such study is required for applicants completing a program of dental education in an unregistered or unaccredited dental school. Dr. Restrepo -Jaramillo enrolled in the two-year advanced program in general dentistry at the Eastman Dental Center of the University of Rochester and successfully completed the program in June 2008. This program is acknowledged by the State Board for Dentistry as the substantial equivalent of the two-year program required in regulation.

RECOMMENDATION: The Committee on the Professions, in concurrence with the Acting Executive Secretary of the State Board for Dentistry, recommends that the applicant's successful completion of the advanced program in general dentistry at the University of Rochester be accepted as the substantial equivalent of the required two academic years of dental study in a registered or accredited dental school program. In addition, the Committee approves the one-year Temporomandibular Joint Dysfunction Program at Eastman Dental Center as fulfilling the pre-professional education deficiencies.

Statement of Problem: Commissioner’s Regulations require that an applicant for licensure who has graduated from a program of dental education in an unregistered or unaccredited dental school must complete two academic years of study in an accredited dental school program. This program must culminate in certification from the dental school that the applicant has achieved the level of knowledge and clinical proficiency expected of a graduate of that school. Dr. Mitsumoto enrolled in the two-year advanced program in general dentistry at the Eastman Dental Center of the University of Rochester and will successfully complete the program in June 2009. This program is acknowledged by the State Board for Dentistry as the substantial equivalent of the two-year program required in regulation.

Petition for: Conferral of the degree Doctor of Medicine (M.D.) pursuant to Section 6529 of the Education Law.
Summary Statement: The petitioners listed below are all graduates of foreign medical schools who have been licensed in New York.
The applicable requirements of Section 3.57 of the Rules of the Board of Regents require completion of a medical education program in a foreign medical school satisfactory to the Department which does not grant the degree Doctor of Medicine (M.D.), and in which the philosophy and curriculum were equivalent, as determined by the Department in accordance with the policy of the Board of Regents, to those in programs leading to the degree Doctor of Medicine (M.D.) at medical schools in the United States satisfactory to, or registered by, the Board of Regents and the Department. Secondly, petitioners must have licensure to practice medicine in New York State in accordance with provisions of Section 6524 or 6528 of the Education Law or their equivalent as determined by the Board of Regents pursuant to their authority under Section 6506 of the Education Law.
