Proposed Handling

 

This question will come before the Higher Education and Professional Practice Committee at its December meeting where it will be voted on and action taken.  It will then come before the full Board at its December 2007 meeting for final action.

 

Procedural History

 

Section 6506(5) of the Education Law and Section 24.7 of the Rules of the Board of Regents authorize the Regents to waive education, experience and examination requirements for a professional license as well as to confer the degree Doctor of Medicine.

 

Background Information

 

There are 22 licensing petitions and 26 requests for the conferral of the degree Doctor of Medicine for review and approval.

 




Recommendation

 

It is recommended that the Regents approve the recommendations of the Committee on the Professions regarding licensing petitions.

 

Timetable for Implementation

ARCHITECTURE

 

Petition for:  Waiver of New York State requirements pertaining to acceptability of licensing examinations for licensure by endorsement.

 

Summary Statement:  The petitioners listed below are all graduates of professionally accredited architecture programs who have applied for licensure in New York.  All have achieved, at a minimum, a Bachelor of Architecture degree.  All petitioners have substantial documented licensed experience in other states.

 

              Prior to 1983, certain states did not require the Equivalency Examination (EE) or the Qualifying Test (QT) if a candidate had a degree from an accredited architecture program, and granted licensure upon passage of the Professional Examination (PE).  Prior to 1975, most states recognized the Examination Syllabus (ES).  The petitioners  passed either the national Professional Examination (PE) given prior to 1983, or portions of the national Examination Syllabus (ES) given prior to 1975.  Prior to 1983, New York State required passage of the Equivalency Examination (EE), or passage of the Qualifying Test (QT) in addition to passage of the national Professional Examination.  Each of the petitioners satisfied the examination requirement in his/her initial state of licensure by passing an acceptable licensing examination and attained licensure in that state.

 

              Section 7304(4) of Education Law and Section 69.3 of the Commissioner’s Regulations require for endorsement that “… an architect licensed in another state or jurisdiction as the result of successful completion of only the professional examination in use before 1983 may be granted licensure upon presentation of evidence of two years of work experience of a grade and character satisfactory to the State Board for Architecture and passage of a practical examination satisfactory to the State Board for Architecture …”

 

              Each petitioner satisfied the examination requirement in his/her initial state of licensure and has extensive professional practice satisfactory to the State Board.  Since the above information illustrates evidence of competence within the profession, and in lieu of the practical examination, the Executive Secretary of the State Board for Architecture recommends that the examination requirement be considered satisfied and each applicant’s licensure in another state be accepted for endorsement in New York State.

Petition for: Acceptance of passing grades on the Uniform Certified Public Accountancy Examination.

 

Statement of Problem: Commissioner's Regulations required that Ms. Gialanella pass all parts of the Uniform CPA Examination within 36 months.  She  passed the four parts of the Uniform CPA Examination as a New Jersey candidate under conditioning requirements that are different than  the 36-month conditioning requirements in New York.

 

The national Uniform CPA Examination transitioned from a paper-based format to a computer-based format in 2004.  At the point of transition, New York awarded conditional credit for sections passed under the paper-based format for a three-year period starting from the month in which the paper-based section was passed.  Ms. Gialanella passed the Auditing and Business Law/Professional Responsibility sections under the paper-based format in May 1999.  Under New York’s conditioning requirements, she needed to pass the two remaining sections by the end of May 2002 to retain credit for the two sections passed.  New Jersey’s regulations allowed individuals who passed paper-based sections in May 1999 to retain credit for those sections until October 31, 2004.  Ms. Gialanella passed Financial Accounting and Reporting in November 2002 and Accounting and Reporting in May 2003.  This satisfied New Jersey’s conditioning requirements; however, it did not satisfy New York’s shorter conditioning requirements.

 

Based on these unique circumstances, the Executive Secretary for the State Board for Public Accountancy supports Ms. Gialanella’s request to waive the 36-month requirement to pass all four parts of the Uniform CPA Examination.

Petition for: Acceptance of passing grades on the Uniform Certified Public Accountancy Examination.

 

Statement of Problem: Patrick T. Boyle, an applicant for licensure as a CPA, recently passed the four parts of the Uniform CPA Examination.  However, he exceeded the requirement that all four sections be passed within an 18-month period by two months.

 

Mr. Boyle received conditional credit on the Business Environment & Concepts (BEC) section of the examination in October 2005.  He subsequently passed the Regulation (REG) section in February 2006 and the Financial Accounting and Reporting (FAR) section in February 2007.  Mr. Boyle needed to pass the fourth section, Auditing and Attestation (AUD), by June 30, 2007 to retain credit for the BEC section passed in October 2005.  He sat for AUD and passed it in August 2007, approximately two months outside of the conditioning period.

 

In his letter Mr. Boyle explained that his attempts to pass all parts of the Uniform CPA Examination within the 18-month time period were complicated by administrative delays in scheduling and score release. He also provided copies of communications between himself and the exam administrator.  A review of the national candidate database confirms Mr. Boyle’s assertions.        

 

Based on the strength of the documentation provided by Mr. Boyle and the supporting evidence, the Executive Secretary of the State Board for Public Accountancy supports his request to waive the 18-month requirement to pass all four parts of the Uniform CPA Examination.

DIETETICS-NUTRITION

Petition for:  Satisfaction of the education requirement for the associate degree route.

 

Statement of Problem:  Ms. Fine was awarded a B.S. degree in Education from New York University in 1974 and subsequently completed an additional 16 semester credits in social and behavioral sciences at The American University, 33 semester credits in dietetics and nutrition and human biological sciences at New York Institute of Technology and 13 semester credits in human biological sciences at Nassau Community College.  Commissioner’s Regulations require a minimum of 45 semester credits in the professional content area of dietetics and nutrition for applicants seeking licensure through the baccalaureate degree route.  The coursework Ms. Fine completed in her combined studies covers all the required subject areas in both the professional content area and the content area of human biological sciences and social and behavioral sciences; but she has only approximately 30 semester hours in the professional content area. 

 

              However, the semester hours of study completed by the applicant satisfy all the educational requirements for the associate degree route, which requires a passing score on the licensing examination.  Ms. Fine, however, was not awarded an associate degree.  The applicant asks that her Bachelor of Science degree completed at New York University along with her other college study be considered  the substantial equivalent of an associate degree in dietetics and nutrition.

 

APPLICABLE REQUIREMENTS:

QUALIFICATIONS: 

Section 8004(2) of the Education Law and Part 79-6 of the Commissioner's Regulations:

 

(1)  An associate degree based on a program in dietetics or nutrition which includes the equivalent of at least 30 semester hours in the nine curricular areas that constitute the professional dietetics and nutritional content area and at least 15 semester hours in the human biological sciences and social and behavioral sciences content area.

(3)  Endorsements from three dietitians or nutritionists acceptable to the Department

RECOMMENDATION:  The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Dietetics and Nutrition, recommends that the applicant’s education be considered substantially equivalent to an associate degree and that the professional education requirement be considered satisfied.

Petition for:  Acceptance of education.

 

Statement of Problem:  Dr. Albertina did not complete the two academic years of study required in an accredited dental school program culminating in certification that the applicant has achieved the level of knowledge and clinical proficiency expected of a graduate of that school.  Such study is required for applicants completing a program of dental education in an unregistered or unaccredited dental school. 

 

              Dr. Albertina completed the two-year advanced program in general dentistry at the Eastman Dental Center of the University of Rochester on June 30, 2007. This program is acknowledged by the State Board for Dentistry as the substantial equivalent of the two-year program required in regulation.

 

APPLICABLE REQUIREMENTS:

QUALIFICATIONS:

Section 61 of the Regulations of the Commissioner of Education requires:

 

(1) Not less than 60 semester hours of preprofessional education including courses in general chemistry, organic chemistry, biology or zoology, and physics.

(2) Four academic years of dental education culminating in a degree in an acceptable dental school.

(3) Two-year advanced program in general dentistry at the University of Rochester, Eastman Dental Center, Rochester, New York, completed June 30, 2007.

(4) Satisfactory scores on Parts I and II of the National Dental Board Examinations.

(5) Satisfactory performance on the clinical examination administered by the Northeast Regional Board of Dental Examiners.

RECOMMENDATION: The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Dentistry, recommends that the applicant's successful completion of the advanced program in general dentistry at the University of Rochester be accepted as the substantial equivalent of the required two academic years of dental study in a registered or accredited dental school program.

THREE YEAR LIMITED LICENSE IN DENTISTRY

 

Petition for: Three-year limited license to practice Dentistry under Section 6604(6) of the Education Law.

 

Statement of Problem: The applicants listed below have satisfied the education and examination requirements for licensure as a dentist in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.

 

              Each applicant has an opportunity to practice dentistry in an area which has been designated a Federal Dental Health Professions Shortage Area and requests a three-year waiver of the citizenship requirement under Section 6604(6) of the Education Law. Each applicant must sign an affidavit stating the exact location of the shortage area where he/she will practice before the three-year limited license will be issued.

 

Applicable Guidelines: Section 6604(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a dentist in New York State and allows the Board of Regents to grant a one-time, three-year waiver of this requirement for an alien dentist to practice in New York State if all other licensure requirements are satisfied and to grant an additional extension not to exceed six years to enable the alien to secure citizenship or permanent resident status, provided such status is being actively pursued.

Petition for:  Waiver of New York State practical examination requirement.

 

Statement of Problem:  Dr. Hershowitz has not passed a satisfactory practical examination as required for licensure either by the endorsement or examination route.  New York State accepts a passing score on Part III of the National Board of Examiners in Optometry (NBEO) examination to satisfy the practical examination requirement.  The NBEO practical examination was not available when Dr. Hershowitz was licensed in Pennsylvania in 1983 after successfully passing the Pennsylvania State Board Examination.  The state examination for Pennsylvania given in 1983 was administered by the NBEO and is comparable with Part III of the NBEO examination, including both written and clinical sections testing patient management skills.

 

Dr. Hershowitz has documented over 22 years of licensed practice in Pennsylvania and New Jersey.  He became certified in the use of diagnostic pharmaceutical agents and therapeutic pharmaceutical agents in both New Jersey and Pennsylvania. 

 

Based on Dr. Hershowitz's demonstration of clinical skills through more than 22 years of hands-on licensed practice and his success on other professional examinations, the Acting Executive Secretary of the State Board for Optometry recommends that the requirement for a satisfactory practical examination (NBEO Part III) be waived.

 

APPLICABLE REQUIREMENTS:

(2)(a) Passed National Board of Examiners in Optometry (NBEO) Part I, April 1981; Part IIA, April 1982; Part IIB, August 1982 [also passed Treatment and Management of Ocular Diseases August 1993.]

Petition for:  Waiver of New York State practical examination requirement.

 

Statement of Problem:  Dr. Possanza has not passed a satisfactory practical examination as required for licensure either by the endorsement or examination route.  New York State accepts a passing score on Part III of the National Board of Examiners in Optometry (NBEO) examination to satisfy the practical examination requirement.  However, the NBEO practical examination was not available when Dr. Possanza was licensed in Pennsylvania in 1989 after successfully passing the Pennsylvania State Board Examination.

 

Dr. Possanza has documented over 18 years of licensed practice in Pennsylvania.  He was certified in therapeutic pharmaceutical agents in November 2000 and certified to treat glaucoma in July 2003. 

 

Based on Dr. Possanza's demonstration of clinical skills through more than 18 years of hands-on licensed practice and his success on other professional examinations, the Acting Executive Secretary of the State Board for Optometry recommends that the requirement for a satisfactory practical examination (NBEO Part III) be waived.

Statement of Problem: The applicants listed below have met the education and examination requirements for licensure as veterinarians in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.

 

              Each applicant also has a pending application for full veterinary medical licensure, which cannot be granted until he/she satisfies the citizenship or permanent residency requirement.

Petition for: Acceptance of medical education under the guidelines for graduates of CETEC.

 

Statement of Problem: Dr. Turiansky graduated in 1981 from the Universidad Centro de Estudios Tecnicos (CETEC), Santo Domingo, Dominican Republic. He transferred to CETEC after previous study at Universidad Central Del Este, San Pedro de Macoris, Dominican Republic.   CETEC was one of three schools disciplined by the government of the Dominican Republic for fraudulent practices.  The New York State Board of Regents established criteria for acceptance of clinical training performed by CETEC graduates in U.S. hospitals. 

 

Dr. Turiansky is presenting evidence of 48 weeks of clinical training in psychiatry, internal medicine/gastroenterology/hematology/oncology, general surgery, obstetrics and gynecology, and pediatrics in U.S. hospitals to fulfill the Regents criteria.  These criteria require that the hospital attest to the successful completion of the clerkship by the applicant and that students from other medical schools must also have participated in the clerkship at the same time as the applicant. Additionally, the hospitals must confirm that both the scope and content of the clerkship and the performance of the applicant is equivalent to that required of other medical school students at a similar level who performed the clerkship at their hospital. Two hospitals have verified the satisfactory completion by the applicant and the equivalency of the four weeks of obstetric and gynecology clerkships; however, they cannot verify that other students participated in the clerkships at the same time as the applicant. All the other hospitals provided attestations verifying that the applicant satisfied the Regents criteria.

 

Dr. Turiansky successfully completed a four-year accredited residency program in psychiatry at Bergen Regional Medical Center, Paramus, New Jersey.  Additionally, he is certified by the American Board of Psychiatry, 2005. Based on Dr. Turiansky’s total training and National Board certification, Department staff recommend that Dr. Turiansky be approved as satisfying Regents criteria for CETAC graduates. 


 

 

APPLICABLE REQUIREMENTS:

QUALIFICATIONS:

Sections 60.1 and 60.5 of the Commissioner’s Regulations and Regents guidelines of April 1987 allowing for approval of education for graduates of CETEC, CIFAS, and UTESA, provided that the following criteria have been satisfied:

 

(1) The applicant provides for the submission of an affidavit from a licensed physician who is either Director of Medical Education or Chief of Service in which the clerkship occurred.  The physician signing the affidavit must attest that, based on personal knowledge or contemporaneous hospital records, the applicant satisfactorily completed the rotation and the applicant's performance was equivalent to that required of other medical students at a similar level.

(1) The applicant's clerkships were as follows: obstetrics and gynecology (Waterbury Hospital, Waterbury, Connecticut and Metropolitan Hospital Center, New York, New York), Internal medicine/hematology/ oncology/gastroenterology (Hines VA Hospital, Hines, Illinois), general surgery (Saint Mary’s Hospital, Waterbury, Connecticut), psychiatry (St. Mary’s Hospital, Waterbury, Connecticut), pediatrics/ emergency (Metropolitan Hospital Center, New York, New York).  All clerkships meet the Regents criteria except for obstetrics and gynecology.  Those hospitals could not attest to having students from other medical schools in the rotations at the same time.

(2) Thirty-two months of medical education including didactic and clinical training in traditional subjects.

(2)  Thirty-two months of medical education at UCE and CETEC, including didactic and clinical training in surgery, internal medicine, obstetrics and gynecology, and pediatrics and psychiatry.

(3) Sixty semester hours of preprofessional study.

(3)  State University of New Jersey, Rutgers, Newark, New Jersey, 118 semester hours.

(4) Proficiency examination.

(4) ECFMG certification, valid indefinitely as of November 1993. (originally issued in 1983).

(5) Three years of approved postgraduate hospital training.

(5) ACGME accredited Postgraduate Postgraduate Year 1, 2, 3, and 4 in psychiatry from July 1, 1985 to June 30, 1989 at Bergen Pines County Hospital, Bergen Pines, New Jersey.


 

(6) Acceptable scores on a licensing examination in accordance with Section 60.4.

(6)   Acceptable scores on Flex Component 1 (June 1994) and Flex Component 2 (December 1989).

(7) United States citizen or alien lawfully admitted for permanent resident status in the United States.

Summary Statement: The petitioners listed below are all graduates of foreign medical schools who have been licensed in New York.
