Report of Regents Professional Practice Committee to The Board of Regents
The Professional Practice Committee held its scheduled meeting on May 16, 2023. All members were present except Vice Chancellor Josephine Victoria Finn, Regent James E. Cottrell, and Regent Elizabeth S. Hakanson, who were excused. Chancellor Lester W. Young, Jr., Regent Roger Tilles, Regent Judith Chin, Regent Luis O. Reyes, Regent Susan W. Mittler, Regent Aramina Vega Ferrer, Regent Shino Tanikawa, and Regent Adrian I. Hale also attended the meeting, but did not vote on any action.
ACTION ITEMS
Professional Discipline Cases [PCC EXS (A) 1-4]
The Committee recommends that the reports of the Regents Review Committees, including rulings, findings of fact, determinations as to guilt, and recommendations, by unanimous or majority vote, contained in those reports which have been distributed to you, be accepted in 5 cases. In addition, your Committee recommends, upon the recommendation of the Committee on the Professions, that 21 consent order applications, 17 surrender applications be granted, and further recommends that 1 summary suspension application be granted.
These recommendations are made following the review of 43 cases involving seven licensed practical nurses, seven registered professional nurses, four pharmacists, three dentists, three licensed practical nurses who are also registered professional nurses, two certified public accountants, two licensed practical nurses who are also registered professional nurses who are also nurse practitioners in Family Health, two veterinarians, one athletic trainer, one certified public accountancy professional service corporation, one licensed master social worker, one registered professional nurse who is also a nurse practitioner in Adult Health, and one speech-language pathologist.
Proposed Revised Amendment of Section 61.18 of the Regulations of the Commissioner of Education Relating to the Residency Program Requirement for Dental Licensure [PPC (A) 1] - Department staff presented for emergency adoption revised proposed amendments to Section 61.18 of the Commissioner’s regulations to conform them to Chapter 613 of the Laws of 2022 (Chapter 613), which became effective 11/21/22. In response to public comment, the Department has made substantial revisions to the proposed rule by removing obsolete provisions regarding the formal written outcome assessment that accredited residency programs must include. These provisions have been removed since the procedures listed in it are no longer necessary as accrediting standards are now substantially more stringent. The revised proposed amendments add language to the Commissioner’s regulations to continue to require that the assessment include a written statement by the residency program director attesting that the applicant has successfully completed the accredited residency program and is, in the director’s judgment, competent to practice general dentistry or a specialty of dentistry.
The Committee recommends that section 61.18 of the Regulations of the Commissioner of Education be amended, as submitted, effective May 16, 2023, as an emergency action, upon the finding by the Board of Regents that such action is necessary for the preservation of the public health and general welfare in order to timely implement the provisions of Chapter 613 of the Laws of 2022, which became effective November 21, 2022, and to ensure that the emergency action taken at the March 2023 meeting remains continuously in effect.
The motion passed unanimously.
Proposed Amendment of Section 69.2 of the Regulations of the Commissioner of Education Relating to Licensing Examination and Testing Accommodations in the Profession of Architecture [PPC (A) 2] - Department staff presented for emergency action proposed amendments to 69.2 of the Commissioner’s regulations to conform New York State’s architect licensure requirements with national standards set by the National Council of Architectural Registration Boards by amending the examination content requirements and retention of credit provisions and permitting English as a second language testing accommodations for the Architect Registration Examination.
The Committee recommends that section 69.2 of the Regulations of the Commissioner of Education be amended, as submitted, effective May 16, 2023, as an emergency action upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare to immediately conform the Regulations of the Commissioner of Education to the national licensing and testing accommodations standards in the profession of architecture.
The motion passed unanimously.
