Report of Regents Professional Practice Committee to The Board of Regents
The Professional Practice Committee held its scheduled meeting on December 12, 2022. All members were present except Regent Catherine Collins and Regent Elizabeth S. Hakanson, who were excused. Chancellor Lester W. Young, Jr., Regent Susan W. Mittler, Regent Shino Tanikawa, and Regent Roger P. Catania also attended the meeting, but did not vote on any action.
ACTION ITEMS
Professional Discipline Cases [PCC EXS (A) 1-3, 6]
The Committee recommends that the reports of the Regents Review Committees, including rulings, findings of fact, determinations as to guilt, and recommendations, by unanimous or majority vote, contained in those reports which have been distributed to you, be accepted in 6 cases. In addition, the Committee recommends, upon the recommendation of the Committee on the Professions, that 22 consent order applications and 8 surrender applications be granted, and further recommends that 1 summary suspension application be granted.
These recommendations are made following the review of 37 cases involving seven registered professional nurses, six licensed practical nurses, three dentists, three licensed practical nurses who are also registered professional nurses, one acupuncturist, one dentist who is also certified to administer dental anesthesia, one dentist who is also certified to administer dental enteral conscious sedation, one licensed clinical social worker, one licensed master social worker, one licensed master social worker who is also a licensed clinical social worker, one massage therapist, one pharmacist, one pharmacy, one physical therapist, one physical therapist assistant, and one veterinarian.
Restoration [PPC EXS (A) 4]
The Committee recommends that the application of Demetrios Gabriel for the restoration of his license to practice as a Physician in New York State be denied.
Long-Term Clinical Clerkships [PPC EXS (A) 5]
The Committee recommends that the applications for American University of the Caribbean, Saba University School of Medicine, and St. George’s University School of Medicine to place students in long-term clinical clerkships in New York be approved, in accordance with and subject to the recommendations of the Advisory Committee on Long-term Clinical Clerkships.
Proposed Amendment to the Title of Subpart 79-16 and Sections 79-13.1, 79-13.3, 79-13.6, 79-14.1, 79-14.3, 79-15.1, 79-15.3, 79-16.1, 79-16.2, 79-16.3, 79-16.4 and 79-16.5 of the Regulations of the Commissioner of Education Relating to Licensure as a Clinical Laboratory Technologist or Cytotechnologist and Certification as a Clinical Laboratory Technician or Histological Technician [PPC (A) 1] - Department staff presented for emergency adoption proposed amendments to the Title of Subpart 79-16 and Sections 79-13.1, 79-13.3, 79-13.6, 79-14.1, 79-14.3, 79-15.1, 79-15.3, 79-16.1, 79-16.2, 79-16.3, 79-16.4 and 79-16.5 of the Commissioner’s regulations to conform them to Chapter 446 of the Laws of 2022, the majority of which, becomes effective January 17, 2023. Chapter 446, among other things, aligns New York’s clinical laboratory professions’ licensure requirements to national standards in order to meet the increasing need for qualified licensed laboratory professionals and address critical laboratory staffing shortages throughout this State.
The Committee recommends that the title of subpart 79-16 and sections 79-13.1, 79-13.3, 79-13.6, 79-14.1, 79-14.3, 79-15.1, 79-15.3, 79-16.1, 79-16.2, 79-16.3, 79-16.4 and 79-16.5 of the Regulations of the Commissioner of Education be amended, as submitted, effective January 17, 2023, as an emergency action, upon the finding by the Board of Regents that such action is necessary for the preservation of the public health and general welfare in order to timely implement the provisions of Chapter 446 of the Laws of 2022, effective January 17, 2023, which will expand access to clinical laboratory services by increasing the number of clinical laboratory practitioners in New York.
The motion passed unanimously.

The Professional Practice Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations at its meeting on December 13, 2022, copies of which have been distributed to each Regent.
MATTERS NOT REQUIRING BOARD ACTION
Proposed Amendment to Section 69.6 of the Regulations of the Commissioner of Education Relating to the Continuing Education Requirements for the Profession of Architecture [PPC (D) 1] - Department staff presented for discussion proposed amendments to Section 69.6 of the Commissioner’s regulations to conform them to Chapter 578 of the Laws of 2021, which, effective May 3, 2023, amends the Education Law to update the mandatory continuing education (CE) requirements for architects by removing the exemption from the CE requirement for new licensees; allowing the Department to grant a full exemption to the CE requirement for reasons of health certified by an appropriate health care professional, for extended active duty with the armed forces of the United States, or for other good cause acceptable to the Department which may prevent compliance; increasing flexibility for CE activities, including allowing up to six credits to be transferred from one triennial registration period to the next; and allowing architects to take courses in engineering, interior design, land surveying, landscape architecture, and geology, as long as the courses contribute to the practice of architecture and meet the standards prescribed by the Commissioner.
School Vision Clinics - Department staff provided an overview of the school vision mobile clinic held in October 2022 for the Poughkeepsie City School District.
