Your Professional Practice Committee held its scheduled meeting on September 12, 2011.   All Committee Members were present, except Regent Wade S. Norwood, who was excused.  Chancellor Merryl H. Tisch and Regent Kathleen M. Cashin were also present, but did not vote on any case or action.  

ACTION ITEMS


Professional Discipline Cases

Your Committee recommends that the reports of the Regents Review Committees, including rulings, findings of fact, determinations as to guilt, and recommendations, by unanimous or majority vote, contained in those reports which have been distributed to you, be accepted in 6 cases.  In addition, your Committee recommends, upon the recommendation of the Committee on the Professions, that 38 consent order applications and 11 surrender applications be granted, with five members of the committee voting acceptance of the consent application in the case of Thomas Joseph Schuette, Chiropractor, Cal. 25356 and Regent Harry Phillips, III and Regent Geraldine D. Chapey recusing themselves from any consideration of this matter.   [PPC (EXS) 1-3]

In the case of Tyrone Reid, Licensed Practical Nurse, Calendar No. 25475, we recommend the correction that the reference to “certified social worker” be deemed deleted wherever it may appear in the report of the Regents Review Committee in this matter and the profession “licensed clinical social worker” be deemed substituted for each such reference.

In the case of Christina Noel Ryan, Licensed Practical Nurse, Calendar No. 25478, we recommend that the July 18, 2011 Vote and Order in this matter, the Application For Consent Order granted in this matter, and the terms of probation attached as Exhibit “B” to the Application For Consent Order in this matter each be deemed corrected solely insofar as the calendar number of “26478” shown on each of said documents shall reflect the correct calendar number in this matter and be deemed to read the correct calendar number of “25478”; and that the determination rendered on July 18, 2011 shall otherwise remain in full force and effect.

These recommendations are made following the review of 55 cases involving nineteen licensed practical nurses, eleven registered professional nurses, six dentists, six pharmacists, two chiropractors, two licensed practical nurses who are also registered professional nurses, two professional engineers, one certified public accountant, one land surveyor, one licensed master social worker, one massage therapist, and one occupational therapist.


Restoration

Your Committee recommends that the Board of Regents deny the petition for restoration of the registered professional nurse license of Lulex Licerio. Ms. Licerio’s license was originally revoked September 15, 2000.  [PPC EXS (A) 4]


Approvals

Your Committee recommends approval of the following items:

Amendment to Regulations Relating to Mandatory Continuing Education in Massage Therapy – Action on proposed regulations to implement a new law that established continuing education requirements for massage therapists.  (Discussed at June 2011 PPC meeting.)  [PPC (A) 1]

Amendment to Regulations Relating to Education of Professional Midwives and the Practice of Midwifery – Action on proposed regulations to implement a new law relating to the collaborative agreement for midwives and to revise the professional education requirements for midwifery.  (Discussed at June 2011 PPC meeting.)  [PPC (A) 2]

Amendment of Regulations Relating to Collaborative Drug Therapy Management and Continuing Education for Pharmacists – Emergency action on proposed regulations to implement a new law relating to collaborative drug therapy management, involving pharmacists and physicians working together.   [PPC (A) 3]

Amendment to Regulations Relating to Waivers from Corporate Practice Restrictions and Certain Not-for-Profit and Educational Corporations to Provide Services – Emergency action on proposed regulations to implement a 2011 law extending the time for certain entities to apply for waivers from corporate practice restrictions in order to provide social work, mental health, and psychotherapy services.  [PPC (A) 4]

MOTION FOR ACTION BY FULL BOARD

Your Professional Practice Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations at its meeting on September 12, 2011, copies of which have been distributed to each Regent.
