Proposed Handling

This question will come before the full board at its June 2010 meeting where it will be voted on and action taken. 

Procedural History

Section 6506(5) of the Education Law and Section 24.7 of the Rules of the Board of Regents authorize the Regents to waive education, experience and examination requirements for a professional license as well as to confer the degree Doctor of Medicine.

Background Information

There are 7 licensing petitions and 10 requests for the conferral of the degree Doctor of Medicine for review and approval.

Recommendation

It is recommended that the Regents approve the recommendations of the Committee on the Professions regarding licensing petitions.

Timetable for Implementation

Approval of the Committee on the Professions’ recommendations will be effective June 22, 2010.

Petition for: Acceptance of passing grades on the Uniform Certified Public Accountancy (CPA) Examination.

Statement of Problem: Commissioner's Regulations require that an applicant must pass all parts of the Uniform CPA Examination within 18 months.  Nicole Poppham passed the four parts of the Uniform CPA Examination, but she exceeded the time limit. 

Ms. Poppham originally received conditional credit for passing the computer-based Business Environment and Concepts (BEC) and Regulation (REG) sections of the Examination in October/November 2006.  She needed to pass the remaining two sections by June 30, 2008.  She passed the Financial Accounting and Reporting (FAR) section on May 18, 2008 and the Auditing and Attestation (AUD) section on November 17, 2009, both outside the time frame to retain credit for BEC and REG. 

Ms. Poppham has provided documentation of personal factors that impacted her ability to prepare for, and sit for, the Examination for a period of 15 months beginning March 2007.  Based on the documentation and Ms. Poppham’s continued perseverance to continue to sit during this period for the FAR and AUD sections of the Examination, the Executive Secretary of the State Board for Public Accountancy supports Ms. Poppham’s request to waive the 18-month requirement to pass all four parts of the Uniform CPA Examination.

             

APPLICABLE REQUIREMENTS:

Section 7404 of Education Law and Part 70 of the Commissioner’s Regulations requires:

 

(1) A bachelor’s or higher degree based on a program in accountancy.

  • College of Staten Island, Bachelor of Science in Accounting, June 2003.

(2) Passing scores on the Uniform CPA Examination.

(2) (a) July 2004 through April 2006: Auditing, Regulation, and Business Environment and Concepts (failing scores).

     (b) October 2006: Regulation (passing score).

     (c) November 2006: Business Environment and Concepts (passing score).

     (d) February 2007 through February 2009: Auditing and Financial Accounting and Reporting (failing scores).

     (e) May 2009: Auditing (failing score); Financial Accounting and Reporting (passing score).

     (f) August 2009: Auditing (failing score).

     (g) February 2009: Regulation (passing score). 

     (h) November 2009: Auditing (passing score).

(3) Two years of satisfactory experience.

 

RECOMMENDATION: The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Public Accountancy, recommends that the applicant’s petition for acceptance of passing grades on the Uniform CPA Examination be accepted.

DENTISTRY

Petition for:  Acceptance of education.

Statement of Problem:  

              Commissioner’s Regulations require that an applicant for dental licensure must have completed at least 60 semester hours of pre-professional education with required content.  This must be followed by four academic years of dental education satisfactory to the department culminating in a degree, diploma, or certificate in dentistry.  Graduates of non-registered and non-accredited dental programs must also complete two academic years of dental study in a registered or accredited dental school.  It must culminate in a certificate that confirms that the student has achieved the level of knowledge and clinical proficiency expected of a graduate of a registered or accredited dental school.

              Dr. Alarbi completed 30 semester hours of pre-professional education and a four-year dental program (1991-1996) at Tishreen University, Lattakia, Syria, receiving a Doctor in Dental Surgery degree in October 1996. In 1998, Dr. Alarbi entered a four-year specialty program in orthodontics at the Universite Aix-Marseille II, Marseille, France.  He received a specialty certificate in orthodontics from this university in 2002.  The Acting Executive Secretary of the State Board for Dentistry recommends that this program be accepted to fulfill the remaining 30 semester hours of required pre-professional education.

              Following his specialty program at the Universite Aix-Marseille II, Dr. Alarbi became a full-time faculty member and also completed Jacksonville University’s two-year ADA-accredited postgraduate orthodontic program (2007-2009).  The Dean and Orthodontic Program Director at Jacksonville University has stated that, without question, Dr. Alarbi has achieved the level of knowledge and clinical proficiency expected of a graduate of virtually any dental school in the United States. This is based on what he has personally witnessed as well as the applicant’s orthodontic specialty program and his past private practice experiences.  After reviewing Dr. Alarbi’s academic credentials, experience and recommendation letter from the Dean and Orthodontic Program Director at Jacksonville University, the Acting Executive Secretary of the State Board for Dentistry recommends that Dr. Alarbi be considered to have the equivalent of the two academic years of study in an accredited dental school program and has fulfilled the education requirement for licensure.


APPLICABLE REQUIREMENTS:

QUALIFICATIONS:

Section 61 of the Regulations of the Commissioner of Education requires:

 

(1) Not less than sixty semester hours of pre-professional education including courses in general chemistry, organic chemistry, biology or zoology, and physics.

(1) (a) Thirty semester hours of pre-professional education including courses in general chemistry, organic chemistry, biology or zoology, and physics at Tishreen University, Lattakia, Syria, 1991-1992.

(1)(b) Four-year specialty program in orthodontics (1998-2002) at the Universite Aix-Marseille II, Marseille, France.

(2) Four academic years of dental education culminating in a degree in an acceptable dental school.

(2) Four years of acceptable dental education at Tishreen University, culminating in the degree of Doctor of Dental Surgery, October 1996.

(3) Two academic years of study in an accredited dental school program culminating in certification that the applicant has achieved the level of knowledge and clinical proficiency expected of a graduate of that school.

(3) Two-year ADA-accredited postgraduate orthodontic program (2007-2009) at Jacksonville University, experience and recommendation letter from the Dean and Orthodontic Program Director at Jacksonville University.

(4) Satisfactory scores on Parts I and II of the National Dental Board Examinations.

(5) Acceptable clinically-based dental residency program of at least one year’s duration.

(6) United States citizen or alien lawfully admitted for permanent residence in the United States.

 

(7) Evidence of the required course in the identification and reporting of child abuse and maltreatment.

RECOMMENDATION: The Committee on the Professions, in concurrence with the Acting Executive Secretary of the State Board for Dentistry, recommends that Dr. Alarbi’s education requirement be considered fulfilled.

THREE YEAR LIMITED LICENSE IN DENTISTRY

 

Petition for: Three-year limited license to practice Dentistry under Section 6604(6) of the Education Law.

Statement of Problem: The applicant listed below has satisfied the education and examination requirements for licensure as a dentist in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.

              The applicant has an opportunity to practice dentistry in an area which has been designated a Federal Dental Health Professions Shortage Area and requests a three-year waiver of the citizenship requirement under Section 6604(6) of the Education Law. The applicant must sign an affidavit stating the exact location of the shortage area where he/she will practice before the three-year limited license will be issued.

Applicable Guidelines: Section 6604(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a dentist in New York State and allows the Board of Regents to grant a one-time, three-year waiver of this requirement for an alien dentist to practice in New York State if all other licensure requirements are satisfied and to grant an additional extension not to exceed six years to enable the alien to secure citizenship or permanent resident status, provided such status is being actively pursued.

Petition for:  Three-year limited license to practice veterinary medicine under Section 6704(6) of the Education Law.

Statement of Problem: The applicants listed below have met the education and examination requirements for licensure as veterinarians in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.

              Each applicant also has a pending application for full veterinary medical licensure, which cannot be granted until he/she satisfies the citizenship or permanent residency requirement.

Applicable Guidelines: Section 6704(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a veterinarian in New York State and allows the Board of Regents to grant a one-time three-year waiver (plus an extension of not more than one year) for an alien veterinarian to practice in New York State if all other licensure requirements are satisfied.

MEDICINE

Petition for: Conferral of the degree Doctor of Medicine (M.D.) pursuant to Section 6529 of the Education Law.

Summary Statement: The petitioners listed below are all graduates of foreign medical schools who have been licensed in New York.

              The applicable requirements of Section 3.57 of the Rules of the Board of Regents require completion of a medical education program in a foreign medical school satisfactory to the Department which does not grant the degree Doctor of Medicine (M.D.), and in which the philosophy and curriculum were equivalent, as determined by the Department in accordance with the policy of the Board of Regents, to those in programs leading to the degree Doctor of Medicine (M.D.) at medical schools in the United States satisfactory to, or registered by, the Board of Regents and the Department. Secondly, petitioners must have licensure to practice medicine in New York State in accordance with provisions of Section 6524 or 6528 of the Education Law or their equivalent as determined by the Board of Regents pursuant to their authority under Section 6506 of the Education Law.
