Issue for Decision
Should the Regents approve the staff’s recommendation concerning the proposed revision to the initial charter for Academic Leadership Charter School (New York City)?
Background Information
We received a request from the Chancellor of the city school district of the City of New York to revise the initial charter for Academic Leadership Charter School (“ALCS” or “the School”). The School’s charter was initially granted on February 10, 2009 to open August 2009. The School seeks to change its district of location and to modify its enrollment. The School was approved to be located in Community School District (CSD) 4, in the East Harlem section of Manhattan. The New York City Department of Education (“NYCDOE) was unable to provide space for the School in CSD 4. Instead, NYCDOE offered the School space in CSD 7, in the South Bronx section of the Bronx. The enrollment modification includes increasing the number of kindergarten classes from three to four and reducing the number of first grade classes from three to two. The School will maintain its approved total enrollment. However, it will modify its grade enrollment from 75 students in each grade to serve one hundred students in kindergarten and 50 students in the first grade in Year One (see Attachment 1).
The NYCDOE held a public hearing in CSD 7 on August 13, 2009 regarding the proposed revision. No comments were made or received.
Recommendation
VOTED: That the Board of Regents approves the revision to the initial charter of Academic Leadership Charter School as proposed by the Chancellor of the city school district of the City of New York, and the provisional charter is amended accordingly.
Reasons for Recommendation
The proposed revisions to the School’s charter, along with the other terms of the charter: (1) meet the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules, and regulations; (2) will permit the charter school to operate in an educationally and fiscally sound manner; and; (3) are likely to improve student learning and achievement and materially further the purposes set out in subdivision two of section twenty-eight hundred fifty of Article 56 of the Education Law.
Timetable for Implementation
The Regents action for Academic Leadership Charter School will be effective immediately.
