Procedural History
Section 6506(5) of the Education Law and Section 24.7 of the Rules of the Board of Regents authorize the Regents to waive education, experience and examination requirements for a professional license as well as to confer the degree Doctor of Medicine.
Background Information
There are 4 licensing petitions and 26 requests for the conferral of the degree Doctor of Medicine for review and approval.
Recommendation
It is recommended that the Regents approve the recommendations of the Committee on the Professions regarding licensing petitions.
Timetable for Implementation
Approval of the Committee on the Professions’ recommendations will be effective July 28, 2009.

Petition for: Acceptance of passing grades on the Uniform Certified Public Accountancy (CPA) Examination.
Statement of Problem: Veronica Basantes, an applicant for licensure as a CPA, recently passed the four parts of the Uniform CPA Examination. However, she exceeded the 18-month conditioning requirement by two months.
Ms. Basantes sat for and passed the Regulation (REG) section of the Examination in May 2007. She needed to pass the remaining three sections by December 31, 2008 to retain credit for the REG section. She passed Auditing and Attestation (AUD) in July 2007 and the Business Environment and Concepts (BEC) section in January 2008, both within the 18-month conditioning period. She attempted, but failed the remaining Financial Accounting and Reporting (FAR) section twice within the conditioning period. She made a final attempt and passed the FAR section in February 2009, two months after she lost credit for AUD. As of March 31, 2009, Ms. Basantes also lost credit for the REG section of the Examination.
Ms. Basantes’ efforts to prepare for and pass the BEC and FAR sections were interrupted by her role as primary caregiver for a family member who experienced medical conditions documented by attending physicians and therapists, during the three-month period between January 2008 and April 2008. These demands caused her to lose three months of Examination preparation time.
Based on the medical documentation and her continued efforts to pass the FAR and BEC sections, the Executive Secretary of the State Board for Public Accountancy supports Ms. Basantes’ petition to waive the 18-month requirement to pass all four parts of the Uniform CPA Examination.

RECOMMENDATION: The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Public Accountancy, recommends that the applicant’s petition for acceptance of passing grades on the Uniform CPA Examination be accepted.

THREE YEAR LIMITED LICENSE IN DENTISTRY
Petition for: Three-year limited license to practice Dentistry under Section 6604(6) of the Education Law.
Statement of Problem: The applicant listed below has satisfied the education and examination requirements for licensure as a dentist in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.
The applicant has an opportunity to practice dentistry in an area which has been designated a Federal Dental Health Professions Shortage Area and requests a three-year waiver of the citizenship requirement under Section 6604(6) of the Education Law. Each applicant must sign an affidavit stating the exact location of the shortage area where he will practice before the three-year limited license will be issued.
Applicable Guidelines: Section 6604(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a dentist in New York State and allows the Board of Regents to grant a one-time, three-year waiver of this requirement for an alien dentist to practice in New York State if all other licensure requirements are satisfied and to grant an additional extension not to exceed six years to enable the alien to secure citizenship or permanent resident status, provided such status is being actively pursued.

The limited license may be renewed upon the lawful submission of an application for an extension of not more than six years, at the discretion of the Department.

Statement of Problem: The applicant listed below has met the education and examination requirements for licensure as veterinary technicians in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.
The applicant also has a pending application for full veterinary technology licensure, which cannot be granted until she satisfies the citizenship or permanent residency requirement.
Applicable Guidelines: Section 6711(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a veterinary technician in New York State and allows the Board of Regents to grant a one-time three-year waiver (plus an extension of not more than one year) for an alien veterinary technician to practice in New York State if all other licensure requirements are satisfied.

Petition for: Acceptance of medical education under the guidelines for graduates of CETEC, CIFAS, and UTESA.
Statement of Problem: Dr. Mantovani graduated in 1981 from the Universidad Centro de Estudios Tecnicos, Santo Domingo, Dominican Republic. He transferred to Universidad Centro de Estudios Tecnicos (CETEC) after previous study at Universidad Central Del Este (UCE), San Pedro de Macoris, Dominican Republic. CETEC was one of three schools disciplined by the government of the Dominican Republic for fraudulent practices. The New York State Board of Regents established criteria for acceptance of clinical training performed by CETEC, CIFAS, and UTESA graduates in U.S. hospitals. Dr. Mantovani is presenting evidence of clinical training in pediatrics, surgery, medicine, and obstetrics and gynecology in U.S. hospitals to fulfill the Regents criteria. The criteria requires that students from other medical schools must also have participated in the clerkship. The hospital must attest to the successful completion of the clerkship. Additionally, they must confirm that both the scope and content of the clerkship and the performance of the applicant must be equivalent to that required of other medical school students at a similar level who performed the clerkship at their hospital. For pediatrics, surgery and medicine, the hospital has attested to the satisfactory completion of the clerkships and that other students from other medical schools were rotating at the hospital at the same time as Dr. Mantovani. Hospital records for the obstetric and gynecology clerkship attest to the successful completion of the program and the fact that the hospital did have an accredited residency in that field at that time.
Dr. Mantovani successfully completed a three-year accredited residency program in internal medicine at Mount Vernon Hospital and Jersey City Medical Center and then successfully completed a two-year Pulmonary Fellowship at Winthrop University Hospital. Additionally, he is certified by the American Board of Internal Medicine in Pulmonary Diseases. In the opinion of Department staff, Dr. Mantovani has met the criteria of the Board of Regents.

Regents guidelines of April 1987 allow for approval of education for graduates of CETEC, CIFAS, and UTESA, provided that the following criteria have been satisfied: |

(1) The applicant provides for the submission of an affidavit from a licensed physician who is either Director of Medical Education or Chief of Service in which the clerkship occurred. The physician signing the affidavit must attest that, based on personal knowledge or contemporaneous hospital records, the applicant satisfactorily completed the rotation and the applicant's performance was equivalent to that required of other medical students at a similar level. |
(1) Applicant completed clerkships at Jersey City Medical Center in pediatrics, surgery and medicine that fulfill the Regents criteria. The obstetrics and gynecology clerkship at St. Mary’s Hospital (Hoboken, New Jersey) was successfully completed. The hospital could only confirm that they did have an accredited residency program in that field at that time. |
(2) Thirty-two months of medical education including didactic and clinical training in traditional subjects. |
(2) Thirty-two months of medical education at UCE and CETEC, including didactic and clinical training in surgery, internal medicine, obstetrics and gynecology, and pediatrics. |

Petition for: Conferral of the degree Doctor of Medicine (M.D.) pursuant to Section 6529 of the Education Law.
Summary Statement: The petitioners listed below are all graduates of foreign medical schools who have been licensed in New York.
The applicable requirements of Section 3.57 of the Rules of the Board of Regents require completion of a medical education program in a foreign medical school satisfactory to the Department which does not grant the degree Doctor of Medicine (M.D.), and in which the philosophy and curriculum were equivalent, as determined by the Department in accordance with the policy of the Board of Regents, to those in programs leading to the degree Doctor of Medicine (M.D.) at medical schools in the United States satisfactory to, or registered by, the Board of Regents and the Department. Secondly, petitioners must have licensure to practice medicine in New York State in accordance with provisions of Section 6524 or 6528 of the Education Law or their equivalent as determined by the Board of Regents pursuant to their authority under Section 6506 of the Education Law.
