The question will come before the Higher Education Committee at its December 2008 meeting where it will be voted on and action taken.  It will then come before the full Board at its December 2008 meeting for final action.

 

Procedural History

 

Rabbi Isaac Elchanan Theological Seminary (RIETS) submitted its self-study in the spring of 2008.  In June 2008, a peer review team visited the Seminary.  The Department completed its final report on the application for accreditation in October 2008.  On November 14, 2008, the Regents Advisory Council on Institutional Accreditation voted unanimously to recommend that the Board of Regents accredit RIETS for a five year period, with a reporting requirement.  Neither RIETS nor the Senior Deputy Commissioner of Education appealed that recommendation to the Commissioner.

 

 

Background Information

              The Seminary has been chartered as a separate entity since 1970.  Prior to that time it was a component of Yeshiva University.  The Seminary’s accreditation was most recently renewed in 2002, following a peer review visit.  RIETS is authorized to offer programs leading to the Master and Doctor of Hebrew Literature, the Master and Doctor of Religious Education degrees, and Advanced Certificates.  In practice, about three-quarters of the Seminary’s students (288 of 383 in 2007) are in a four-year Advanced Certificate program also resulting in rabbinical ordination.

Recommendation 

 

It is recommended that the Board of Regents accredit Rabbi Isaac Elchanan Theological Seminary for a period of five years, ending on December 30, 2013, with the requirement that within one year of Regents action the Seminary provide a report documenting implementation of the 16 recommendations in the compliance review report.

 

Regents with a conflict of interest, or the appearance of a conflict of interest, on this application are asked to recuse themselves from participating in the deliberation and decision.

Timetable for Implementation

If the Board of Regents renews the institutional accreditation of RIETS, that determination will go into effect immediately.  On the basis of that action, the Department will renew the registration of RIETS’ programs of study.  In addition to the required progress report at the end of the first year, RIETS is required to submit accreditation data reports annually and a mid-point accreditation report 30 months following Regents action. 

Information in Support of Recommendation

 

Peer Review Visit.  In preparation for a visit by a peer review team, Rabbi Isaac Elchanan Theological Seminary (RIETS) prepared a self-study following the requirements for self-study in the Handbook of Institutional Accreditation.  On June 19, 2008, a peer review team visited the Seminary.  It examined the institutional self-study and other documents; met with faculty, students, and administrators; examined the facilities and other academic resources; and observed classes.  It made 16 recommendations.  In the team’s judgment, none of the recommendations rose to a level that would materially affect the Seminary’s compliance with accreditation standards and requirements.  The team made the following recommendation on accreditation action:

 

Peer Review Team Recommendation:  Accreditation for a period of five years with the requirement that within one year the institution provide a report documenting implementation of the 16 recommendations in the compliance report.

 

              The Department transmitted the team’s draft compliance review report to RIETS, providing it 30 days to prepare a written response correcting factual errors and addressing any other aspect of the report and any recommendations in it.  The draft report, RIETS’ response, and the Department’s preliminary recommendation for accreditation action became the final compliance review report.

 

              Regents Advisory Council Review.  As required by Subpart 4-1, the Department transmitted the final compliance review report, including its preliminary recommendation for accreditation action, for consideration by the Regents Advisory Council on Institutional Accreditation.  (The Advisory Council is established in §3.12(d) of the Rules of the Board of Regents “to review applications for accreditation and renewal of accreditation pursuant to Part 4 of this Title, and such other matters as the department may ask it to review and make recommendations to the Regents and the commissioner based on its review.”)

 

Department’s Preliminary Recommendation:  Accredit for a period of five years with the requirement that within one year the Seminary provide a report documenting implementation of the 16 recommendations in the compliance review report.

 

              On November 14, 2008, the Advisory Council met to review RIETS application and to make a recommendation to the Board of Regents on its accreditation.  In a public meeting, it met with representatives of the Seminary, the staff coordinator of the accreditation review, and the chair of the visiting review team.  Following presentations by the staff coordinator, the Chair of the review team, the Dean of the Seminary, the principal readers of the accreditation materials, and ensuing questions and discussion, the Advisory Council unanimously made the following recommendation to the Board of Regents on accreditation action:

 

Regents Advisory Council Recommendation:  Accredit for a period of five years with the requirement that within one year the Seminary provide a report documenting implementation of the 16 recommendations in the compliance review report. 

 

              Attachment A is the Final Compliance Review Report considered by the Advisory Council, including the Summary and Preliminary Recommendation on Accreditation Action.

 

              Commissioner’s Review.  Neither RIETS nor the Senior Deputy Commissioner of Education appealed the Advisory Council’s recommendation.  Therefore, pursuant to Subpart 4-1, the Commissioner adopted its recommendation as his recommendation to the Board of Regents:

 

Commissioner’s Recommendation:  Accredit for a period ending December 30, 2013, with the requirement that within one year of Regents action the Seminary provide a report documenting implementation of the 16 recommendations in the compliance review report.

 

              Attachment B sets forth the range of accreditation actions authorized in Subpart 4-1 of the Rules of the Board of Regents.
