Proposed Amendment of Sections 100.5(a) and (b) and 100.4(d) of the Regulations of the Commissioner of Education Relating to Exemptions from Diploma Assessment Requirements for Major Life Events (Emergency Action) - Department staff will present the proposed amendment to the Commissioner’s regulations to allow a superintendent (or the principal/head of school of a registered nonpublic school or charter school, as applicable) to make a local determination to provide exemptions from the diploma assessment requirements for students who experienced a major life event prior to the planned administration of a required diploma assessment (i.e., Regents Examination, NYSED-Approved Regents Examination Alternative, or a NYSED-Approved Pathway Assessment). Perkins V State Plan - Department staff will update the Board on public response to the proposed revisions to the Perkins V State Plan and request approval for submission to USDE in May 2025. Proposed Amendment of Section 135.5 of the Regulations of the Commissioner of Education Relating to First Aid Course Requirements for Coaches - Department staff will present proposed amendments to section 135.5 of the Regulations of the Commissioner of Education Relating to First Aid Course Requirements for Coaches. Proposed Amendment of Section 19.5 of the Rules of the Board of Regents and Section 200.22 of the Regulations of the Commissioner of Education Relating to the Prohibition of Corporal Punishment, Aversive Interventions, Prone Restraint and Seclusion, and Standards for Behavioral Interventions - Department staff will present both a proposed amendment of Section 19.5 of the Rules of the Board of Regents to conform with the amended Section 305 of the Education Law (as added by Chapter 551 of the Laws of 2024) that prohibits corporal punishment in all schools public and private, and a proposed amendment to Section 200.22 of the Regulations of the Commissioner of Education indicating behavioral interventions for students with disabilities will be provided in accordance with Section 19.5 of the Rules of the Board of Regents. |

Proposed Amendment of Sections 52.21, 80-1.2, 80-3.7, and 80-5.6 and Subpart 80-6 of the Regulations of the Commissioner of Education Relating to Teaching Assistant Certification - Department staff will present proposed regulatory amendments to establish Initial and Professional Teaching Assistant (TA) certificates; outline when the current Level I, II, and III TA certificates would no longer be issued; expand the pool of eligible candidates for the Pre-Professional TA certificate; allow one year of experience under the Pre-Professional TA and new Professional TA certificates to satisfy the teaching experience requirement for the individual evaluation pathway to Initial teaching certification; codify that holders of the new Professional TA certificate would complete registration and continuing teacher and leader education (CTLE) requirements; and create requirements for institutions of higher education to register programs that lead to Professional TA certification. |

Proposed Amendment of Sections 66.5 and 66.6 of the Regulations of the Commissioner of Education Relating to the Use of Therapeutic Pharmaceutical Agents and Continuing Education Requirements for Licensed Optometrists Certified to Prescribe and Use Therapeutic Pharmaceutical Agents (Emergency Action) - Department staff will present for emergency action a proposed amendment of sections 66.5 and 66.6 of the Commissioner’s regulations to conform them to Chapter 516 of the Laws of 2024, which effective November 22, 2024, amended the Education Law to add nasal sprays to the list of topical therapeutic pharmaceutical agents that optometrists are authorized to use for the treatment of dry eye disease. Proposed Amendment of Section 17.6 of the Rules of the Board of Regents Relating to the Regulation of Surrender of License Orders in Disciplinary Proceedings in the Professions - The profession of pharmacy is the only profession where the executive secretary of a State Board must also agree to the licensee’s or registrant’s statement before a surrender order can be presented to the Board of Regents for its consideration and action. This requirement can result in delays in the surrender order process and resolution of disciplinary matters involving licensed pharmacists and/or registered pharmacy establishments. To address this issue, Department staff will present a proposed amendment to section 17.6 of the Regents Rules to eliminate this requirement, which will further the protection of the public by enabling the surrender order process for disciplinary matters involving licensed pharmacists and registered pharmacy establishments to be completed more expeditiously. |
