SUMMARY:
Attached are summary recommendations with respect to charter applications. A total of 24 charter actions are recommended involving 24 institutions, including 2 museums, 5 libraries, 12 nonpublic schools, 3 chartered postsecondary institutions, 1 education corporation and 1 not-for-profit corporation.
I recommend that the Regents approve each application in accordance with the recommendations contained in the respective summaries.

AMENDMENT OF CHARTERS

HILLVIEW FREE LIBRARY
Diamond Point, Warren County
An absolute charter in the first instance was granted to this corporation by action of the Board of Regents on December 19, 1901 to operate a public library to serve the area in Warren County bounded on the north by Trout Lake Road, on the west by East Schroon River Road, on the south by Diamond Point Road and on the east by Lake George. The board of trustees has applied for an amendment to the absolute charter to add the language necessary to maintain tax-exempt status under Internal Revenue Code �501(c)(3). Janet M. Welch and the Office of Cultural Education recommend that the absolute charter be amended accordingly.

ROCKVILLE CENTRE PUBLIC LIBRARY
Hempstead, Nassau County
A provisional charter was granted to this corporation by action of the Board of Regents on June 5, 1894 to operate a public library to serve Union Free School District 21 in the Town of Hempstead. Such provisional charter was made absolute on December 15, 1898. Such absolute charter was amended on March 29, 1963. The board of trustees has applied for an amendment to the absolute charter to change the terms of the elected trustees from five years to three years and to add the language necessary to maintain tax-exempt status under Internal Revenue Code �501(c)(3). Janet M. Welch and the Office of Cultural Education recommend that the absolute charter be amended accordingly.

A provisional charter was granted to this corporation by action of the Board of Regents under the corporate name "The Early Childhood School" on July 31, 1981 to establish a nursery and kindergarten school for children with handicapping conditions from three through six years of age. Such provisional charter was extended by Regents action on February 22,1985 and was amended to change the corporate name to "Early Childhood Education Center" and, as so amended, extended by Regents action on November 18, 1988 subsequent to an order by Regents action consolidating the School with the Early Childhood Education Center, a not-for-profit corporation. Such charter of the consolidated corporation was extended by Regents action on December 21, 1990 and amended by Regents action on July 22, 1994 and, as so amended, made absolute. The board of trustees has applied for an amendment to the absolute charter to authorize the corporation to also operate at 215 Washington Avenue Extension, Albany, New York 12205; 3736 NY Route 43, West Sand Lake, New York 12196; and Pinebush Elementary School, Carman Road, Schenectady, New York 12303. The Office of Vocational and Educational Services for Individuals with Disabilities (VESID) has been provided with an opportunity to review this action and the trustees have been advised that the granting of the amendment does not constitute approval for state funding for programs and services under the jurisdiction of VESID. Thomas E. Hogan and the Office of Nonpublic School Services recommend that the absolute charter be amended accordingly.

The board of trustees has petitioned the Board of Regents to form a corporation to provide educational services to children who have been identified as having a disability, or who are considered "at risk," between the ages of three and six, within New York City and to establish and operate day care centers. These educational services shall include special classes in an integrated setting, multidisciplinary evaluation services and Special Education Itinerant Teacher (SEIT) services. The Office of Children and Family Services (OCFS) has consented to this action pursuant to �460-a of the Social Services Law. Thomas E. The board of trustees has petitioned the Board of Regents to form a corporation to establish and operate day care centers for children in Nassau County, New York; a center-based preschool for children from birth to three years of age; a toddler program for children from eighteen months to three years of age; a nursery school for preschool children from three to five years of age and a kindergarten; an after-school program for children from five to eleven years of age; and a summer program for children from birth to eleven years of age. The board of trustees has applied for an amendment to the provisional charter to change the corporate address to 4100 Lyell Avenue, Rochester, New York 14606 and, as so amended, for an extension of the provisional charter. The board of trustees and the board of directors have petitioned the Board of Regents, pursuant to Education Law �223, for an order of consolidation of Rosa Lee Young Childhood Center and Rosa Lee Young Childhood Center, Inc. Rosa Lee Young Childhood Center has petitioned the Board of Regents for a provisional charter. Rosa Lee Young Childhood Center, Inc. was incorporated under �402 of the Not-For-Profit Corporation Law (NPCL) on November 6, 1972. Upon the effective date of the consolidation of Rosa Lee Young Childhood Center and Rosa Lee Young Childhood Center, Inc., Rosa Lee Young Childhood Center will assume all the assets, liabilities and responsibilities of both organizations. The consolidated corporation will operate under the provisional charter granted to Rosa Lee Young Childhood Center. The Office of Children and Family Services (OCFS) has consented to this action pursuant to �460-a of the Social Services Law. Thomas E. A provisional charter was granted to this corporation by action of the Board of Regents on January 22, 1975 to operate a nursery school for children of northeastern Tompkins County. Such provisional charter was made absolute by Regents action on April 27, 1979. The board of trustees has petitioned the Board of Regents for the dissolution of the charter because the corporation has had declining enrollment making it difficult to meet expenses and all taxes payable by the corporation have been paid. The trustees request Regents approval for the distribution of the remaining assets to The Day Care and Child Development Council of Tompkins County, Inc., a not-for-profit corporation incorporated under the Department of State on June 23, 1972. Thomas E. Hogan and the Office of Nonpublic School Services recommend that the absolute charter of Etna Nursery School be dissolved and that its assets be distributed to The Day Care and Child Development Council of Tompkins County, Inc.

Such provisional charter was amended on April 11, 1973, June 28, 1974 and June 27, 1975 and was consolidated by Regents action on June 21, 1979 with Jewish Teachers Seminary and People�s University, a domestic corporation incorporated pursuant to Chapter 593 of the Laws of 1935 and Herzliah Hebrew Teachers Institute, Inc., which was incorporated by action of the Board of Regents under the corporate name "Herzliah Hebrew Academy, Inc". on February 15, 1923 and amended by Regents action on February 15, 1946 to change the corporate name to "Herzliah Hebrew Institute, Inc." Such provisional charter was amended and extended numerous times, and was made absolute by Regents action on January 17, 1990. Such absolute charter was again amended by Regents action on September 19, 1997. The board of trustees has applied for an amendment to the absolute charter to add authority for the University to confer the degree of Doctor of Physical Therapy (D.P.T.) at the Main Campus in Manhattan and at its Branch Campus in Huntington, New York.
