Report of Regents Professional Practice Committee to The Board of Regents

Regents Committee on Professional Practice 

Regent Norwood, Co-Chair, Regent Cottrell, Co-Chair, Regent Cea, Regent Collins, Regent Wills, Regent Catania, and Regent Hale. 

The Professional Practice Committee held its scheduled meeting on May 7, 2024. All members were present except for Regent James E. Cottrell and Regent Catherine Collins, who were excused. Chancellor Lester W. Young, Jr., Vice Chancellor Judith J. Chin, Regent Luis O. Reyes, Regent Aramina Vega Ferrer, Regent Hasoni L. Pratts, Regent Patrick A. Mannion, and Regent Seema Rivera also attended the meeting, but did not vote on any action. 

ACTION ITEMS

Professional Discipline Cases [PCC EXS (A) 1 – 3]

The Committee recommends that the reports of the Regents Review Committees, including rulings, findings of fact, determinations as to guilt, and recommendations, by unanimous or majority vote, contained in those reports which have been distributed to you, be accepted in 8 cases.  In addition, the Committee recommends, upon the recommendation of the Committee on the Professions, that 32 consent order applications and 15 surrender applications be granted.

These recommendations are made following the review of 55 cases involving twelve registered professional nurses, seven licensed practical nurses, six certified public accountants, three dentists, three licensed practical nurses who are also registered professional nurses, three pharmacists, two licensed master social workers who are also licensed clinical social workers, two physical therapists, one clinical laboratory technician, one licensed practical nurse who is also a registered professional nurse who is also a nurse practitioner in Adult Health, one massage therapist, one occupational therapist, one public accountancy partnership, one registered professional nurse who is also a nurse practitioner in Family Health, one respiratory therapist, and one respiratory therapy technician who is also a respiratory therapist.

Restorations [PPC EXS (A) 4]

The Committee recommends that the application of Nishant Nadpara for the restoration of his license to practice as a Physician in New York State be denied.

MOTION FOR ACTION BY FULL BOARD

The Professional Practice Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations at its meeting on May 7, 2024, copies of which have been distributed to each Regent.

MATTERS NOT REQUIRING BOARD ACTION

Proposed Amendment of Sections 74.1, 74.6, 79-9.3, 79-10.3, 79-11.3 and 79-12.3 and Repeal of Section 74.5 of the Regulations of the Commissioner of Education Relating to Social Work and Mental Health Practitioner Supervision Requirements, Acceptable Accrediting Bodies for Social Work Education Programs, and the Social Work Psychotherapy Privilege [PPC (D) 1] – Department staff presented proposed amendments to: (1) sections 74.6, 79-9.3, 79-10.3, 79-11.3, and 79-12.3 to amend the supervision requirements for social workers and mental health practitioners to allow these professions to receive face-to-face supervision through secure, real-time technology acceptable to the Department, such as videoconferencing; (2) subdivisions (a) and (b) of section 74.1 of the Commissioner’s regulations to remove the reference to the Council on Social Work (CSWE) because the standards of private organizations, such as CSWE, may change and no longer by considered equivalent to New York standards, which is consistent with regulations in other related professions that do not name specific organizations; and (3) repeal section 74.5 of the Commissioner’s regulations, which established the licensed clinical social worker psychotherapy privilege requirements because, effective January 1, 2023, Chapter 818 of the Laws of 2022 eliminated the psychotherapy privilege established under the Insurance Law for certain licensed clinical social workers.
